Over the last several years, e-bikes have experienced a significant rise in popularity throughout Southern California cities and towns, including Carlsbad, Oceanside, and Encinitas. Yet e-bikes have also been linked to a rise in personal injury rates, including serious harm that includes bone fractures and traumatic brain injuries (TBIs). To be sure, the American College of Surgeons recently reported that e-bikes are linked to at least 20,000 injuries and 3,000 hospitalizations annually, and those numbers are likely underreported. Despite known risks, e-bikes continue to gain popularity.

Recognizing that these motorized vehicles may be here to stay, the California Independent Electric Mobility Council was formed in October 2025, and it will begin studying the safety risks associated with e-bike usage in the state.

Council Plans to Study E-Bike Safety and Injury Risks

The newly formed California Independent Electric Mobility Council, according to a report from California Public Radio, was created through a grant from Honda. The Council’s task will be to “study what makes e-bikes dangerous” while also assessing “how to make them safer without discouraging people from using them.” If e-bike popularity is going to remain, it is crucial for e-bike makers and riders alike to know how injuries can be avoided.

The Council is made up of a range of people, including trauma nurses, CalBike policy directors, and engineers, among others.

Filing an E-Bike Injury Claim in Southern California

If you were injured in an e-bike accident, or if someone you love was injured in an e-bike accident, you may be wondering about your options for filing a claim. The safety risks associated with these vehicles are well known, but that does not mean that another party may not be liable for injuries. To be sure, there are various circumstances in which another motorist, or even a bicyclist or another e-bike rider, could be responsible for a collision in which an e-bike rider has been harmed.

You should also keep in mind that California follows a “pure” comparative fault rule, which means that even if you were partially at fault for an e-bike accident in which you were injured, you can still recover damages from another party or parties whose negligence also played a causal role in the accident.

In order to file a claim, it is critical to get in touch with a personal injury lawyer in Carlsbad who can help you determine who may be liable for your injuries and gather evidence proving that party should be held responsible. Under California law, you will likely have only two years from the date of the e-bike accident to file your lawsuit, so it is essential to begin working on your case with an attorney as soon as possible.

Contact a Carlsbad Personal Injury Attorney for Assistance with Your Claim

E-bikes are dangerous, but injured riders may be able to seek compensation for injuries after a serious accident. It is important for you to know that you are not liable for your own injuries simply because you decided to ride a motorized bike that comes with risks. If another party’s negligent or careless behavior caused an accident in which you were injured, one of our Carlsbad personal injury attorneys can help you to seek financial compensation for your losses. Contact the North County Injury Lawyers today to find out more about filing an e-bike injury claim in California.

Over the last two decades, cycling as a mode of transportation and recreation has risen for youth and young adults in urban areas, including cities in San Diego County. With the increase in bicycling, children and young adults aged 15 to 39 years old have experienced decreasing rates of cardiovascular disease and other conditions associated with poor health and obesity, according to an article in the journal Frontiers in Public Health. At the same time, however, as disease rates have decreased, the increased use of cycling for both transportation and recreation has resulted in a rise in cyclist road injuries among this age group. It is important to understand the risk of injury due to an accident, and the ways in which it may be possible to seek compensation.

Rising Rates of Road Injuries Among Youth and Young Adult Cyclists

With more cyclists on the roads over the last twenty years, injury rates in accidents and collisions have risen. Whether the reduction in disease rates outweighs these injury rates is something that must be studied further, the authors of the recent article suggest. Yet their research does show that cyclist road injuries have become a cause for serious concern. The study reported in Frontiers in Public Health reveals that cyclists between the ages of 15 and 39 currently “face twice the risk of fatal injuries per mile compared to automobiles passengers,” and that “the likelihood of sustaining a fatal injury while cycling is 12 times greater than while driving a car.”

According to the National Highway Traffic Safety Administration (NHTSA), more than 1,100 people are killed in bicycle collisions with automobiles every year, and that number does not account for deaths that result from other types of bicycle accidents. Thousands more cyclists sustain fatal injuries.

Seeking Compensation After a Serious Bicycle Accident

When a teenager or young adult is seriously injured or killed in a cycling accident, it may be possible to file a claim and to hold the at-fault driver or other responsible party accountable. An injured cyclist can be eligible to file an Encinitas personal injury claim themselves, while a family member may be eligible to file a wrongful death claim after a fatal bicycle injury.

What types of injuries are most common in bicycle accident injury claims that arise out of bicycle accidents? According to the study in Frontiers in Public Health, the following injuries typically prove to be debilitating or fatal most often:

● Traumatic brain injuries and other forms of head trauma;
● Spinal cord injuries; and
● Limb fractures.

Children, teens, and young adults can sustain particularly severe injuries in bicycle accidents and collisions in North County San Diego, and many of their injuries result from another party’s negligence.
Bicycle accidents in Rancho Bernardo and throughout Southern California often result from negligent motor vehicle drivers. While bike collisions can result in cyclists sustaining a wide range of both nonfatal and fatal injuries, bone fractures are serious injuries and are especially common in these types of collisions. After traumatic brain injuries (TBIs), bone fractures are the most common, yet serious nonfatal injury associated with bicycle accidents, and these fractures can result in total and sometimes permanent disabilities. A study published in the peer-reviewed journal Injury suggests that certain types of bone fractures are more likely in bicycle accidents than others and that sex, age, and even the type of bicycle can be predictive factors. Our Rancho Bernardo personal injury lawyers can tell you more.

Study on Bone Fractures in Bicycle Crashes

Broken bones are one of the leading causes of nonfatal injuries in bicycle accidents, yet even though many bone fractures do not result in fatalities, they often have debilitating consequences. In terms of the type of bicycle, riders of mountain bikes and road bikes were significantly less likely than riders of traditional bicycles — of all ages — to sustain serious nonfatal bone fracture injuries in collisions. The authors of the study suggest that this is due in part to the fact that collisions involving road bikes and mountain bikes tend to be more severe and often result in fatalities as opposed to nonfatal injuries.

Adults were significantly more likely than children to sustain broken bones in bicycle accidents, accounting for nearly 80 percent of all bone fracture injuries assessed in the study. The researchers in the study also found that men were slightly more likely than women to sustain bone fractures in bicycle accidents. While older adults are more likely than younger adults to suffer broken bone injuries, the majority of cyclists who sustained bone fractures in bicycle accidents were not at an age where broken bones begin to become more likely.

Common Types of Nonfatal Broken Bone Injuries

The study’s “major peak” ages for bone fractures were 13 and 47. Most bone fractures affected the forearm, followed by the hand, humerus, tibia, ankle, and clavicle.

According to the Cleveland Clinic, bone density issues typically begin to affect adults around the age of 50, but serious bone fractures can occur at any age. The severity of a bone fracture will depend on the fracture pattern and the part of the body where the bone is broken. Generally speaking, oblique and transverse fractures tend to be easier to heal than greenstick, comminuted, segmental, and spiral fractures. Any of these types of fractures can affect the body parts discussed above, and the likelihood of full recovery or long-term disability will depend on the nature of the break and factors related to the individual.

Bicycle accidents in Southern California occur much too frequently, and they typically happen because a motorist is not paying sufficient attention to the road or fails to properly share the road with a cyclist. Bicycle accidents can also happen when roadways and bike lanes are not properly maintained. When a bicycle accident does occur, and another party may be at fault, it is important to seek advice from a Rancho Bernardo bicycle accident attorney about filing a claim and seeking financial compensation.
Whether you regularly walk or ride your bicycle in Escondido or elsewhere in Southern California, you likely know that pedestrian and bicycle injuries and deaths have become a serious concern. Over the last several years, the rate of pedestrian and bicycle deaths rose dramatically, doubling between 2010 and 2022. While California also has one of the largest populations and number of cyclists and pedestrians in the country, it should be a safer place for people of all ages to walk and ride their bicycles. Recognizing the need to take bicycle and pedestrian safety seriously. The California Office of Traffic Safety (OTS) recently announced that it would be investing $149 million in improving pedestrian and bicycle safety throughout the state with the aim of reducing the number of injuries and deaths. Our Escondido personal injury attorneys can tell you more about the funding and how it will be used, and we are here to assist you if you are already injured in a collision and need assistance filing a claim.

Federal Funding to Reduce Pedestrian and Bicyclist Road Deaths

Federal funding is aimed at the state of California to reduce pedestrian and bicyclist road deaths. The $149 million being disbursed by the OTS will go to agencies across the state in the form of 497 grants to “focus on the expansion of overall road safety and enforcement programs,” according to a report from KCRA news. The funding came after data revealed that 177 pedestrians and cyclists were killed in accidents in California in 2022, compared with only 599 back in 2010.
According to an OTS spokesperson, “from the federal government, it’s clearly a priority to reverse this trend that we’re seeing,” which averages out to approximately 12 people suffering fatal injuries daily in California pedestrian and bicycle accidents. The goal is to reduce the number of pedestrian and bicyclist fatalities in the state to zero.

Methods of Injury Reduction for Pedestrians and Bicyclists

How will the funding be used, exactly? The methods and efforts will be multiple, focusing on varied approaches to reduce accident rates from different vantage points. The first issue, which has been on the minds of safety advocates in California for some time, is the infrastructure. There is a need for more bike lanes and safer places for pedestrians to walk and cyclists to ride. In addition, some of the money will be spent on law enforcement efforts. There will be increased “bicycle education,” according to the KCRA report, and an increase in DUI checkpoints throughout the state.

From neighborhood streets in San Clemente to larger and more urban roads in other parts of San Diego County, it is likely that e-bike and electric scooter accidents and injuries are occurring more often than they have in the past. According to a recent report in the San Francisco Examiner, a new study conducted by researchers at the University of California, San Francisco (UCSF) reveals that, over the last five years alone, the rate of e-bike and e-scooter crashes and injuries has risen significantly.

With more teens out of school during the summer, and with more visitors to Southern California, these numbers could ultimately show spikes over the summer months. Who is responsible when these accidents occur? And how can an injured person seek compensation? Our San Clemente e-bike accident attorney can provide you with more information.

Surge in E-Bike and E-Scooter Popularity

Even as municipalities in California have instituted rules to make e-bikes and e-scooters safer, alongside state laws, serious crashes and injuries have continued to occur. Part of the issue is simply the rise in popularity of these types of vehicles or modes of transportation. They are often depicted as environmentally friendly alternatives to driving, and they allow pedestrians and commuters to reach destinations much more quickly than they could on foot or on a traditional bicycle.

The authors of the UCSF study emphasize that, in addition to the rising popularity of these vehicles, there is still a lack of a “culture of safety,” and with that omission, a common failure among e-bike and e-scooter riders to wear helmets. As a result, it is relatively common for riders to sustain severe and life-threatening head injuries when accidents do occur.

Rising E-Bike and E-Scooter Injury Rates

As more Americans continue to purchase or rent e-bikes and e-scooters, the overall rate of accidents and injuries is likely to continue to rise, as well, unless actions are taken quickly to improve safety. In addition to head injuries, including traumatic brain injuries (TBIs), which often affect e-bike and e-scooter operators who are not wearing helmets, limb injuries (including to the arms, hands, and wrists) are also common.

Just how significant has the rise in injury rates been? According to the study published in JAMA Open Network, over the last five years, e-bike injuries have increased by almost 100 percent, and e-scooter injuries have risen by about 45 percent annually. The authors of the study emphasize that cities and counties where these vehicles are especially popular need to consider infrastructure changes to make the roads safer for smaller vehicles like e-bikes and e-scooters. At the same time, it is important to know that in e-bike and e-scooter collisions involving automobiles, the car or truck driver may be at fault. In those cases, it is critical to gather information at the scene and to find out more about filing a claim.

Electric bikes, or e-bikes for short, have become extremely popular in Southern California. As a report from NBC 7 San Diego points out, the cities of Carlsbad and Encinitas recently declared states of emergency due to deaths in e-bike crashes. Both adults and children alike are suffering serious and fatal injuries in collisions involving these forms of transportation, and while they remain popular and accessible, state legislators in California want to change the rules concerning their legality. In short, a new bill that remains before the state legislature “would prohibit kids under 12 from riding e-bikes and require an online test and license.”

As the report underscores, the new bill is designed to “tighten e-bike rules” and to make it more difficult for riders to use e-bikes without any kind of safety training or knowledge. Our San Clemente personal injury attorneys can tell you more.

Learning More About E-Bikes and Injury Risks in San Diego County

Whether you are in San Clemente or elsewhere in San Diego County, you probably see e-bike riders on the road, on paths, and even sometimes on sidewalks where they are not supposed to be riding. A recent article in the Los Angeles Times reported that speeding is a major issue in e-bike collisions. Although the speed limit is set in the single digits for most e-bikes in certain beach areas, for example, many riders are clocked at speeds of more than 20 miles per hour, and many e-bikes reach speeds of up to nearly 30 miles per hour. When an e-bike rider speeds, they can injure themselves and other e-bike owners or renters, as well as pedestrians, skateboarders, and regular bicyclists.

Common injuries include but are not limited to:

Traumatic brain injuries (TBIs), which include concussions;

Severe abrasions;

Severe lacerations;

Crush injuries;

Broken bones; and

Traumatic amputations.

Text of the Proposed Bill

The proposed bill to restrict e-bike use to riders aged 12 and older and to those who are properly licensed was introduced several months ago and remains before the state legislature. It is not yet clear whether the bill will pass, but if it were to, it would essentially create a type of driver’s license requirement to ride an e-bike lawfully in California.

In addition to the age requirement for e-bike use, AB-530, the proposed law, “would create an e-bike license program with an online written test and a state-issued photo identification for those persons without a valid driver’s license.” The aim of the bill is to reduce injuries and to make e-bike riding safer throughout the state.

The City of San Marcos, California, emphasizes that electric bicycles, or e-bikes for short, have become “more popular than ever and allow people of many ages and abilities to enjoy cycling with assistance from an electric motor.” Indeed, e-bikes have become so popular that many Southern California cities have instituted specific rules concerning e-bikes, including where and how they can be used. Yet as e-bikes gain in popularity throughout California and the country, emergency departments are also seeing increasingly more injuries from e-bike accidents.

While many Californians and visitors to the state have been reading about potential e-bike dangers for a few years now, are e-bikes actually much more dangerous than we thought? According to an article in Fortune, trauma specialists are concerned that “we’re on the front edge of a new order of danger on both bike paths and roadways.” What do you need to know about recent assessments of e-bike safety risks? Our San Marcos injury attorneys can say more.

E-Bike Injuries Increase Alongside Rise in Sales

Data from the Consumer Product Safety Commission (CPSC) suggests that e-bike sales rose significantly between 2017 and 2021, and it is likely that the pattern has continued from 2021 through 2023. As sales numbers have increased, so have injury reports, according to Fortune. Indeed, trauma specialists report that they are seeing more patients with significant accident-related injuries, and some of them may not even be accurately reported as e-bike injuries. Accordingly, the injury rates could be even worse than the numbers recorded. In 2021 alone, US sales of e-bikes reached about 900,000, which is “a near doubling of sales from just one year earlier.”

What are those recorded numbers? Between 2017 and 2021, the National Transportation Safety Board (NTSB) identified 53 deaths from e-bike accidents and hundreds more nonfatal injuries. Anecdotally, motorists report collisions or near-collisions with speeding e-bikes, and e-bike riders show up in emergency departments with traumatic brain injuries (TBIs), severe fractures to arms and legs, spinal injuries, and serious road rash. As the article suggests, the “statistics will likely continue to balloon” concerning e-bike sales and accompanying injuries.

Liability for E-Bike Accidents

After an e-bike accident, it is essential to find out about liability. In other words, who is responsible for injuries in an e-bike accident? The answer to that question will depend upon the circumstances of the accident.

In many cases, speeding is a primary cause of e-bike collisions with motor vehicles. According to Fortune, e-bike riders can ride through intersections at speeds that they would be unlikely to “ever reach on a conventional bicycle.” Yet motorists also play a role in these crashes as a result of distracted driving, as well as aggressive driving and intoxicated driving. The best way to determine liability after an e-bike accident and to seek compensation is to have an attorney evaluate your case.

Contact a San Marcos E-Bike Accident and Injury Lawyer Today

California has become a hot spot for e-bikes, and residents and visitors to the state alike are buying and renting e-bikes for transportation and recreation. Yet, as the facts in the Fortune article underscore, e-bikes can be extremely dangerous and are frequently involved in severe and fatal accidents. If you or someone you love suffered a serious injury in an e-bike accident, you should discuss your options with a San Marcos personal injury lawyer as soon as you can. Contact the Walton Law Firm to learn more about how we can assist you.

Bicyclists in Poway and throughout Southern California are often at risk of serious and deadly injuries in collisions involving negligent motorists. While San Diego County and Los Angeles County, for example, have taken some steps to address the high rate of bicycle injuries and deaths, such as adding new bike lanes, cyclists in Southern California continue to get hurt in avoidable crashes that result from careless or reckless drivers who engage in distracted driving, aggressive driving, and intoxicated driver. According to a recent report from ABC News, “the state of the bike and pedestrian infrastructure” is still not what it could be, and cyclists continue to be involved in deadly crashes.

Learning More About Bicycle Accident Injuries and Deaths in Southern California

As that ABC News report underscores, “between 2018 and 2022” in the Los Angeles area alone, “an average of 35 bicyclists died and more than 2,500 were injured.” The majority of those crashes had four things in common: They occurred on roads with higher speed limits (of 35 miles per hour or higher), on roads that had three or more lanes going in either direction, at nighttime, and on roads without dedicated bike lanes. Approximately 50% of deadly bicycle collisions in Southern California, based on data from an ABC7 analysis, happen between 6:00 pm and 6:00 am, and nearly 80% of all deadly collisions occur on roads where there are no dedicated bike lanes or other forms of “bike infrastructure.”

Moreover, approximately 80% of the severe and deadly bicycle collisions that occur happen on roads identified as “High Injury Networks” that are primarily “in underserved communities . . . that have a higher share of people of color, low-income residents, or areas that are vulnerable to multiple sources of pollution.” The key, the article intimates, is putting more money toward protected bike lanes since shared bike lanes (with symbols or signage) tend to “do absolutely nothing to improve safety.”

Filing a Bicycle Accident Claim

Until more improvements are made to the infrastructure to reduce the rate of bicycle crashes, it is important for cyclists to know more about how they can hold a negligent driver accountable while seeking compensation.

It may be possible to file a bicycle accident lawsuit against the liable party, which is often a negligent driver. To ensure that you remain eligible to file a civil lawsuit, it is essential to talk with an attorney to determine the timeline for your case. Most bicycle crash claims have a two-year statute of limitations under California law, but in some cases, claims must be filed within six months or one year from the date of the injury.

Bicycling in Escondido and throughout Southern California is a popular activity and mode of transportation, but it can also be extremely dangerous. Whether you only ride a bicycle occasionally or you are on a bike several days a week, it is essential to understand how bike crashes happen, who is often liable, and what you can do in order to seek compensation. According to a recent study from BikeLA reported in KTLA news, a “vast majority of deadly collisions involving cyclists happened on roads that don’t have dedicated bike lanes.” In other words, bike lanes could be essential in the goal of preventing bike accidents and injuries in Southern California. What else should you know about the study? Our Valley Center personal injury attorneys can provide you with more information.

Getting the Facts About Bicycle Injuries and Lack of Bike Lanes

Are bike lanes the answer to preventing a majority of bicycle injuries in Southern California? According to the BikeLA study, in assessing bicycle accident deaths from 2022, “the most regular contributing factor . . . was a lack of dedicated infrastructure for cyclists.” Indeed, about 85% of bike accident fatalities occur on roads that do not have dedicated bike lanes.

In addition to a lack of bike lanes, other factors that are cited most often as contributing to deadly bicycle accidents include vehicle speeding, poor lighting on the street, and streets that have multiple traffic lanes. Overall, however, the data suggest that the presence of dedicated bike lanes may be able to reduce deaths among cyclists.

What Should I Do After a Bicycle Accident?

If you are injured in a bike crash or a collision with an automobile in Southern California, what steps do you need to take in order to be able to seek compensation and hold the at-fault motorist accountable? In general, the essential steps to take following a bicycle accident are similar to those you would take after many types of accidents involving personal injuries:

Document the scene of the accident visually as best as you can, using your phone to take photos and videos that show the broader area where the accident happened and close-up images of injuries or property damage;

Get the contact information for anyone who was involved in the accident (including the driver who may have struck you), as well as for anyone who might have witnessed the bike accident;

See a doctor as soon as you can, understanding that some injuries may be obvious, but others might not immediately yield symptoms but will nonetheless require quick treatment so that they do not worsen or cause life-threatening complications;

Begin working with a Southern California bicycle accident attorney as soon as you can to ensure that your claim is filed on time; and

Determine the statute of limitations for your claim (which is likely two years under California law, but could be as short as six months or one year for accidents that may involve public property or government employees), and file your claim before the clock runs out.

Do bicycle helmets actually prevent serious brain injuries when bike accidents happen in Poway or elsewhere in Southern California? In other words, do bike helmet laws make cycling safer? And do laws requiring bicycle helmets actually have their intended effect, or are there unintended consequences, too? A recent article in Slate discusses the “cult” of bike helmets and the ways in which this “modern safety obsession” might actually cause more harm than good. What should you know about biking safety, bike helmets, and injuries in Southern California? Our Poway bicycle accident lawyers want to discuss the Slate article and provide you with more information about filing a bicycle injury claim.

Benefits Versus Harms of Bike Helmet Laws

As you may know, California law requires minors (those under the age of 18) to wear a helmet if they are riding a bicycle, but adults aged 18 and older are not required by law to wear a helmet while bicycling in California. Bicycle helmet laws are set by states, which means they vary from state to state. What are the pros and cons of bike helmet laws?

In terms of the benefits of wearing a bicycle helmet, the National Safety Council (NSC) reports that “helmets are key when it comes to injury prevention” in a bicycle accident. Indeed, when a bicyclist wears a helmet properly and is involved in a crash or a collision, the helmet “could save your life,” the NSC underscores. The NSC indicates that a “bike helmet is a cyclist’s best line of defense, reducing the risk of head injury by more than 50 percent,” and in terms of severe traumatic brain injuries, “the protective benefit is even higher.” Yet more than 55 percent of adults in the U.S. say that they regularly ride a bicycle without a helmet, even when they are required by law.

While you might assume that bicycle helmet laws result in more riders wearing helmets and avoiding injuries, the Slate article has a different suggestion. According to that article, bike helmets might not actually be as important as we have been led to believe.

Bike Helmets Might Not Actually Reduce a Significant Number of Injuries and Laws Requiring Them Can Have Additional Limitations

The ways that bike helmets are tested may not account for the dynamics of many bicycle accidents that actually occur. Indeed, “lab tests of helmeted dummies in vertical free fall do not capture how most people hit their heads while bicycling.” In addition, those lab tests “fail to capture a whole body in most, which some experts argue underestimates impact forces.” Further, it is likely that bike helmet studies do not accurately capture the ways safety gear protects from head trauma. Indeed, “bicycle helmets have only limited potential to protect from serious head injury in high energy impacts or when a cyclist is overrun by a motor vehicle.”

Moreover, as the article in Slate ultimately suggests, marginalized communities can be disproportionately impacted by bike helmet laws. This is an issue to consider when, ultimately, new research suggests that “wearing a helmet is like bringing a knife to a gunfight.” In other words, unless a cyclist is involved in a single-vehicle (the bicycle) accident and no other parties are involved, whether or not a cyclist is wearing a helmet may not be as important as previous studies have suggested.

Since the start of the pandemic, more California residents have been spending time outside walking and bicycling. At the same time, more people are choosing to travel by car than ever before instead of taking forms of mass transit. As more people use bicycles and more motor vehicles are on the roads, there are increased accident and injury risks. According to a report from U.S. News & World Report, the rate of deadly bicycle accidents in California hit a 25-year high in 2020, and both accident and injury rates persist throughout the state. While overall bicycle injury and death rates have risen across the country, they have been markedly high in California. When a bicycle accident happens in Vista, who is liable? Consider some of the following information from our Vista bicycle accident lawyers.

Negligent Motorists are Often Liable for Bike Collisions

When a bicyclist is injured in a collision with a motor vehicle, the driver of the motor vehicle is often at fault and liable for injuries. There are many different ways in which driver error can cause collisions with bicyclists, including distracted driving, intoxicated driving, and aggressive driving.

Much too often, motorists are distracted and are not paying proper attention to the road. In those circumstances, a driver might not notice a bicyclist on the road, or might not look in the bike lane before making a right-hand turn. Likewise, intoxicated drivers might not see bicyclists and will not have the capacity to safely share the road. In other circumstances, motorists might be in a rush and speeding, or they might even engage in road rage behaviors involving cyclists that can lead to collisions. In any of these situations, as well as many others, the driver can be responsible for harm.

Auto and Bicycle Defects

In some bike crashes, product defects are to blame. For example, an automobile involved in the collision might have defective brakes that prevented the motorist from stopping and avoiding a collision with the bicyclist. Or, for example, the bicyclist might have purchased a bike with defective tires or defective handlebars that contributed to a crash. Under such circumstances, the injured bicyclist could be eligible to file a product liability lawsuit.

Government Liability for Damaged Road

Sometimes bicycle accidents happen because of road damage or uncleared road debris. While bicyclists cannot expect all roads and bike lanes to be in constantly pristine condition, an injured bicyclist may be able to hold a government entity accountable when negligent road maintenance resulted in serious bicycle accident injuries.

In order to file a government claim, a bicyclist will need to follow specific steps and will need to do so quickly. In most cases involving government agencies, California law requires an injured bicyclist to file a claim with the agency within 6 months from the date of the bicycle accident. The government can either approve your claim, or deny your claim. If your claim is denied, you may then be able to move onto filing a lawsuit to seek compensation with assistance from a Vista personal injury attorney.

More residents of Southern California are purchasing bicycles, and much of the increased demand for bikes has been driven by the COVID-19 pandemic. According to a study from the Pew Charitable Trusts, as a result of the pandemic, many people decided to spend more time outside and bought bicycles for recreation and travel. Given the combination of an increased number of cyclists on the road and motorists who have proven to be more aggressive than in years before the pandemic struck, bicycle fatalities have risen, and most of those deaths involve collisions with bicycles and automobiles. Indeed, urban fatalities have risen by nearly 50%, and bicycle accident death rates have also increased in suburbs across America.

If you have recently begun cycling, or if you are a seasoned bicyclist but recently suffered injuries in a crash involving a car or truck, what should you know about bicycle accidents and safety?

Common Causes of Bicycle Collisions Involving Motorists

The most serious bicycle accidents are those in which a cyclist is struck by a motorist in a car or truck. Pew points out that California and most other states across the country have specific laws that are designed to protect bicyclists from these types of accidents known as “safe passing laws.” Yet just because such laws are in place does not mean that motorists will necessarily abide by those laws, and in fact, many crashes involving cars and bicycles involve traffic violations committed by the motorist.

Some of the most common causes of bicycle accidents in Southern California include the following:

Distracted driving, which can involve a motorist texting or talking illegally on a smart phone while driving, taking his or her hands or eyes of the wheel for other reasons, or even taking his or her mind off the task of driving and veering into a bicyclist, for example, in the next lane;

Impaired driving, which can involve driving after consuming alcohol or using any kind of illegal or prescription or over-the-counter medication; and

Aggressive driving, which can take many different forms such as speeding, running red lights or stop signs, tailgating other motorists or bicyclists, or aggressively passing bicyclists and putting them at risk of a collision.

Taking Steps to Reduce Your Risk of Injury in a Bicycle Accident in Southern California

It is important for new and seasoned bicyclists alike in Southern California to take steps to avoid crashes with negligent motorists. The following are tips from the National Highway Traffic Safety Administration (NHTSA):

Always purchase a bike that fits your size;

Ensure that your brakes work;

Purchase and wear protective and reflective gear, and put a light on your bicycle;

Learn proper signaling;

Keep your shoe laces and pant legs tucked to avoid them getting caught in the bicycle chain;

Know your route, and consider avoiding the most dangerous times of day to ride (usually between 6:00 p.m. and 9:00 p.m.); and

Never ride your bicycle after you have been drinking alcohol.

Is e-biking in Encinitas and throughout San Diego County actually a safe activity, or are cyclists at risk of serious injury when using pedal-assisted electric bikes? A recent deadly e-bike accident in California highlights the serious risks associated with e-bikes and the need to consider safety issues, as well as liability, in the aftermath of a crash. Our experienced Encinitas personal injury attorneys can evaluate your bike accident case today and help you to determine your eligibility for filing a claim for financial compensation.

Details of the Recent E-Bike Accident in California

For many California residents and visitors to the state, riding an e-bike can be a good way to enjoy the outdoors and to get some exercise, yet e-bikes are also extremely dangerous. According to a recent article in People Magazine, a mother recently sustained deadly injuries in an e-bike accident, and her two sons were injured. The accident occurred in San Juan Capistrano on the San Juan Creek Trail on a recent Saturday evening.

The article explains that the mother, Jennifer Macy, 36, had been riding an e-bike on the San Juan Creek Trail with her two sons strapped into bike seats. The two sons are aged 3 and 4. Reports indicate that Macy “hit the curb and all three were thrown onto rocks on the side of the trail.” One of the children sustained “major trauma,” while the other sustained more minor injuries. Both of Macy’s sons are expected to survive the accident, but Macy’s injuries were fatal. Both of Macy’s sons were wearing bicycle helmets at the time of the collision, but Macy was not wearing a helmet.

Understanding E-Bike Risks and Injuries

In the aftermath of the San Juan Capistrano fatal accident, there are renewed questions coming up about the safety of e-bikes and the likelihood of a serious or deadly injury. Dr. Tetsuya Takeuchi, who serves as trauma medical director at Mission Hospital, indicated that “electric bike accidents often yield injuries that are more similar to motorcycle crashes than typical bike accidents” since they occur at “higher speeds” than collisions involving regular bicycles. Common injuries in e-bike accidents can include but are not limited to the following:

Traumatic brain injuries;

Broken bones;

Spinal cord injuries;

Internal bleeding and organ damage; and

Other catastrophic injuries.

Should anyone really be riding e-bikes, especially with children in tow? E-bikes do have health benefits, but they also have injury risks. According to an article in The New York Times, e-bike popularity has grown rapidly, and both “interest in and sales of pedal-assisted electric bikes surg[ed] during the pandemic.” Yet recent studies of e-bikes suggest that it is critical for riders to consider the accompanying injury risks. Indeed, a study published in Injury Prevention indicated that, although all kinds of bicycle accidents can result in serious and debilitating injuries, “e-bike injuries were the most severe and likely to require hospitalization.”

Bicycle accidents can involve people of any age, but children can be particularly susceptible to serious and fatal injuries in bicycle accidents in Poway and throughout Southern California. A recent article in People Magazine told the story of a 12-year-old girl who sustained traumatic brain injuries in a bicycle accident in the Los Angeles area and later died from the injuries. She had been riding her bike downhill with a friend when the accident happened. Despite wearing a helmet, her brain injuries proved fatal. The tragic accident underscores the serious risk of injury that kids can face in bicycle accidents and emphasizes the need for parents and guardians to learn more about safety precautions.

Learning More About Child Bicycle Accidents and Injuries

Child injuries in bicycle accidents are much too common. The following are some statistics from Stanford Children’s Health, Nationwide Children’s, and Safe Kids Worldwide:

Every year, an average of 100 children suffer fatal injuries in bicycle accidents and approximately 254,000 kids suffer nonfatal injuries in these accidents;

Bicycle-related accidents and injuries result in 25 children in the U.S. requiring treatment in an emergency department every hour, which is about 608 cases every day on average;

Between 2006 and 2015, more than 2.2 million kids between the ages of 5 to 17 received treatment in U.S. emergency departments for injuries sustained in bicycle accidents;

Child bicycle accident injuries happen most frequently in streets, with accidents at home (such as in driveways) being the second-leading site of child bicycle accidents;

Kids under the age of 14 are at greater risk of injuries in a bicycle accident, with children between the ages of 10 to 14 at greatest risk;

Male children account for a much high rate of bicycle accident injuries (anywhere from 70% to 83% of all report fatal and nonfatal bicycle accident injuries);

Head injuries are the leading cause of death in child bicycle accidents, accounting for approximately 60% of all fatal injuries;

Bicycle accidents involving a collision with a motor vehicle are responsible for about 90% of all child deaths in bike crashes; and

Helmets are the best way to prevent a serious or fatal brain injury, yet only about 40% of all kids wear helmets while riding bikes and only about 35% of those kids who do wear helmets actually wear them properly.

Preventing Serious Bicycle Accident Injuries Among Children

What can parents and caregivers do to prevent serious bicycle accident injuries? According to Safe Kids Worldwide, it is critical for parents to require their kids to wear helmets and to ensure that their children are wearing the helmets properly. In addition, parents and caregivers should teach their children to ride safely, which often means avoiding busy roads with heavy traffic, riding recklessly, listening to music on headphones while bicycling, and other actions that can put the bicyclist at risk of serious harm.

Is bicycling becoming more dangerous in Valley Center and throughout San Diego County? Bicyclists in San Diego have been voicing concerns for quite some time about serious and deadly bike accident injuries in Southern California, and many safety groups have pushed for the creation or renovation of bike lanes. Yet according to a recent article in CaliforniaHealthline.org, bicycle accidents continue to result in life-threatening and fatal injuries in the state. Indeed, as the article points out, as of late January 2020, the overall rate of bike accident deaths in California had reached a 25-year high.

Rise in California Bike Accident Deaths

According to the article, between 2016-2018, California had the highest rate of fatal bicycle accidents “for any three-year period since the mid-1990s.” During that period, the average death rate for bicycle accidents reached its highest point since the early 2000s. This information comes as cities across California expand bike share programs and more residents invest in bicycling.

Overall, bicycle accidents are rising across the country. In other words, California is not alone in its bicycle fatality problem. However, rates of bike accident deaths have risen faster in some California counties than in many other parts of the country. The rising rate of bike accident deaths likely has to do, in part, with the increased popularity of cycling.

Of all regions of California, Los Angeles County had a particularly high rate of bicycle fatality increases, as did Sacramento County, San Bernardino County, and San Joaquin County.

Staying Safe While Bicycling in San Diego County

If you regularly ride your bicycle in Valley Center or elsewhere in San Diego County, it is extremely important to understand ways of reducing your risk of getting hurt in a serious bike accident or collision with an automobile. The League of American Bicyclists offers some of the following tips for avoiding a collision:

Always be alert, and continuously be on the lookout for any drivers who do not appear to be abiding by traffic safety rules and regulations;

Make sure you are predictable, riding in bike lanes when possible and avoiding any sudden turns or lane changes when you are riding with motor vehicle traffic;

Use bicycle safety products, including lights and reflectors on your bicycle, as well as a DOT-approved helmet;

Do not wear headphones while you are cycling, even if you are on a bike path or another trail outside traffic zones;

Never ride on the sidewalk, even if it looks like there are few pedestrians;

Do your best to make eye contact with motorists, and make use of hand signals and verbal cues if you are planning to pass or turn;

Never ride within three feet of parked cars to your right or left, or else you can be injured in a “dooring” accident if a driver opens his or her door;

Know that you must yield to pedestrians as if you are a motorist;

Abide by all traffic rules and regulations when you are sharing the road with motorists; and

Remain calm.

During the summer, more kids in San Clemente are outside riding bicycles. Yet even during the months when school is in session, children and teens in Southern California rely on bicycles for recreation, as well as for transportation. According to a recent article in Safety + Health Magazine, more than 2.2 million kids between the ages of 5 and 17 visited emergency departments for bicycle accident injuries between the years 2006 and 2015. That data comes from a recent study conducted by researchers at Nationwide Children’s Hospital Center for Injury Research and Policy.

The study was published in the journal Accident Analysis & Prevention, and it underscores the need for better safety protocols when it comes to preventing child injuries in bicycle accidents in San Clemente and throughout the country.

Bicycle Accidents Lead to Serious Injuries Among Children

Anyone who is involved in a bicycle accident in San Diego County can suffer severe injuries, especially if the bicycle accident involves a collision with a motor vehicle. However, children often suffer more severe bicycle accident injuries and at higher rates than adults. According to the authors of the study, on average 600 kids per day require medical attention for bicycle injuries. Many of the children share certain characteristics, namely age and gender similarities. More than 70% of those kids were boys, and nearly half of them were between the ages of 10 and 14.

What types of bicycle accident injuries are children most likely to sustain? The following are the key findings from the study concerning injury types and prevalence:

Most commonly injured body parts included arm injuries, leg injuries, facial injuries, and head and neck injuries;

Arm injuries accounted for 36% of all injuries;

Legs injuries account for 25%;

Facial injuries made up about 15% of all reported injuries;

Head and neck injuries accounted for about 15% of all injuries to body parts;

In terms of the most common type of injury, the researchers identified bruises, scrapes, and cuts;

Bruises and scrapes were most common, accounting for nearly 30% of all injuries;

Cuts account for about 23% of child bike accident injuries;

Traumatic brain injuries (TBIs) are also frequent and account for about 11% of all reported injuries; and

TBIs are most common in kids between the ages of 10 and 14, an age group that represented 44% of all brain injuries.

Preventing Bicycle Accidents Injuries in Children and Teens

The authors of the study emphasize that children need to wear bicycle helmets each time they ride a bike, and that this is the most effective way to prevent serious and debilitating injuries. An article in Kids Health recommends the following safety tips to prevent bike accident injuries in kids and teens:

Always wear a helmet;

Wear bright clothes;

Use reflectors on bikes;

Wear proper footwear (so that laces cannot get caught in a bike chain, for example);

Only ride on appropriate streets and roads;

Follow the rules of the road; and

Learn and use hand signals.

Many Southern California bicycle safety advocates are concerned about the rise in severe and fatal bicycle accidents in the state, according to a recent article in the Los Angeles Daily News. Whether you regularly ride your bicycle in Oceanside or elsewhere in San Diego County, it is important to recognize the risks that cyclists face on the roads and to be sure that you are following safety tips to avoid a preventable bicycle collision. Of course, there are crashes that simply can not be avoided by a bicyclist’s actions no matter how careful he or she may be. When an automobile driver is careless or reckless, cyclists in Southern California can suffer the consequences.

Cycling Accidents and Hit-and-Run Crashes in Southern California

Despite the fact that traffic collisions more generally have been on the decline, the rate of severe and deadly bicycle accidents has been rising. According to the article, fatal bicycle crashes have been occurring at a startling rate, and many of them have been hit-and-run accidents. Now, as the article suggests, the Southern California “local bicycle community [is] in a ‘red alert’ state of anger and fear.

In the month of April alone, eight bicyclists suffered fatal injuries in collisions with motor vehicles in Los Angeles County, and other collisions occurred in the same month throughout the state. In a number of these cases, the motor vehicle drivers fled the scene of the accident, leaving the injured bicyclist to die. The ages of the bicycle accident victims have varied widely, with riders as young as 15 years old and riders as old as 82 years old. According to Ted Rogers, who documents traffic collisions impacting bicyclists in Southern California, finding a way to stop hit-and-run accidents is “the key to everything.” As Rogers underscores, “there are just so many drivers who are willing to let people die in the street.”

Are Road Improvements Enough to Prevent Bicycle Collisions?

When a city decides to make road improvements and to extend spaces for bicyclists, the assumption is that such improvements will help to reduce the rate of bicycle accidents in the region. For the most part, these changes to the infrastructure can help to reduce the rate of cycling collisions. However, in places like Los Angeles County and San Diego County where so many motorists commute to work and often do not want to share the road with bicyclists, the ability to get road improvements approved and completed can be difficult.

What can cyclists do to help avoid collisions with automobiles? The AAA Foundation for Traffic Safety provides some of the following safety tips:

Wear a helmet every time you ride your bicycle;

Always look ahead of you and not toward the ground;

Ride in a single file, and keep space between other bicycles on the road;

Never ride against traffic—as a cyclist you should act more like a motorist than a pedestrian on the road;

Check out any area where you have not previously cycled before you do so in order to get a sense of the space;

If you are able to do so, avoid busy streets;

Avoid riding your bicycle at “peak traffic times,” such as during rush hour;

Have a friend or family member check your nighttime visibility before you ride your bicycle at night; and

Always keep your bicycle well-maintained, and have it inspected regularly.

Bicycle accidents in Carlsbad happen more often than they should, and according to a recent study at the UC San Francisco, the costs of bicycle collisions are on the rise. According to a fact sheet from the U.S. Centers for Disease Control and Prevention (CDC), trips on bicycles account for only about 1% of all trips that are taken in the country each day. Yet proportionally, bicyclists are at higher risk of suffering a serious or fatal injury in a car accident than are motor vehicle occupants.

As the study explains, the recent rise in bicycle crash costs coincides with an overall increase in cycling popularity. While we want to encourage bicycling in the San Diego area for both health and environmental reasons, it is important to weigh the risks and rewards. The study was published in the journal Injury Prevention.

Medical Costs of Bicycle Injuries Increase by Hundreds of Billions in Two Decades

How much do bicycle accident injuries end up costing every year? In terms of the physical, emotional, and psychological costs of a serious bicycle accident, it can be extremely difficult to quantify the losses. In terms of the economic costs of a bicycle collision, the recent study tells us that they are hundreds of millions per year, totaling hundreds of billions of dollars in the last 17 years.

Specifically, the researchers at UC San Francisco determined that medical costs from bicycle accidents have risen by about $789 million per year on average, resulting in a total of around $237 billion between 1997 and 2013. Those annual costs have risen dramatically in the past five years. For instance, in 2013, bicycle accident costs totaled more than $24.4 billion, which was “approximately double the medical and other various costs involved for all occupational illnesses over the same time period.”

More Emergency Department Visits with Older Male Riders Disproportionately Affected

Does the recent study help us to pinpoint some of the most salient risk factors for bicycle accidents and extensive economic costs? In short, males tend to be involved in more serious bicycle accidents than women, and older riders also appear to be disproportionately affected by bike accident rates. In addition, the study helps to illuminate some shifts in the types of bicycle crashes that are happening and requiring emergency medical treatment.

According to Thomas W. Gaither, one of the authors of the study and a UCSF medical student, “the costs of bicycle injuries have risen steadily since 1997, with a significant increase in emergency department visits and hospital admissions, especially with older men.” In addition, the researchers determined that most bicycle crashes used to happen in non-street accidents, meaning that cyclists might crash on a bicycle trail or might collide with a pedestrian. Now, however, more riders are getting hurt in collisions with motor vehicles, which “increase the velocity of the crash impact and, as a result, the severity of the injury.”

In sum, these are the factors that may play a key role in the rising financial costs of bicycle collisions in Carlsbad and throughout California:

More older people (males in particular) are riding bicycles; and

More collisions are happening with motor vehicles.

The answer to that question depends on the specific facts of the case, but a recent report from NBC 7 News San Diego emphasizes just how important it is to file a bicycle accident lawsuit in Southern California if another party’s negligence results in your injuries. As that report notes, the City Council for the City of San Diego came to a unanimous agreement to pay a $4.85 million settlement to a cyclist who sustained severe and debilitating injuries as a result of an accident caused by uneven pavement.

While many bicycle accidents involve negligent motorists who are not paying attention to their surroundings or motorists who are driving aggressively and strike cyclists, the recent settlement makes clear that matters of premises liability can also affect the rate of bicycle accidents in urban areas.

Details of the Bicycle Accident in San Diego

As the NBC 7 News report articulates, the $4.85 million settlement arises out of a debilitating bicycle accident that occurred on an afternoon in 2014. The plaintiff, Clifford Brown, had been cycling on College Avenue in Del Cerro. At around 1:00 p.m., Brown “hit a portion of uneven pavement.” That incident resulted in the cyclist being “launched more than 20 feet in the air.” In addition to having several of his teeth knocked out, Brown also sustained spinal cord injuries and head trauma.

Who was responsible for the bicycle accident? The injured plaintiff filed a lawsuit against the City of San Diego, alleging that it was responsible for his injuries as a result of the poorly maintained sidewalks. His complaint is not the only one concerning potential premises liability issues throughout the city. One frequent San Diego cyclist, who also owns a bicycle shop, noted that “the descent off of Mount Soledad has a lot of very unsafe rises in pavement, cracks, and potholes.” Other cyclists, too, have highlighted the dangerous riding areas around the city where “they still see dangerous cracks and uneven pavement.”

In response to Brown’s lawsuit, the City of San Diego agreed to a settlement of $4.85 million. A spokesperson for the City of San Diego underscored the severity of Brown’s injuries and emphasizes that “the settlement isn’t about making someone rich, but about making sure Brown is able to pay for his medical expenses for the rest of his life.”

Premises Liability Law and Bicycle Accidents

Who is responsible for a San Diego bicycle accident that happens on a sidewalk? Generally speaking, a premises liability claim, under California law, requires a plaintiff to show the following:

Defendant owned, leased, occupied, or controlled the property;

Defendant was negligent in its maintenance of the property;

Plaintiff suffered a harm; and

Defendant’s negligence was a substantial factor in causing the plaintiff’s harm.

While the City of San Diego may be responsible for poorly maintained roadways, is it always responsible for damaged or poorly maintained sidewalks? As a report from the League of California Cities clarifies, the answer often depends upon where the sidewalk is located. Municipalities in California can “impose a repair obligation for damaged sidewalks on adjacent property owners.”

Eric S. is an avid triathlete. In his early 50s, he is a top age group finisher in the triathlons he enters. To train, he spends many weekly hours on his bike on North County roads. It’s not uncommon for him to ride from his home in San Marcos east through Escondido toward the desert, or west through Carlsbad and up to San Clemente. Like most avid cyclists, he has had many close calls with inattentive drivers, and on January 11, 2011 his luck finally ran out.

On that day, Eric was riding his bike in the bike lane of El Norte Parkway in Escondido when he was cut off by a pickup truck. Eric collided with truck, and the impact knocked him off his bike and into a busy traffic lane. Luckily, he wasn’t struck when he hit the ground. The California Highway Patrol who investigated and made a report of the incident, concluded that the driver of the pickup was at fault for this accident when he failed to yield the right of way to Eric in violation of 22107 of the California Vehicle Code.

Eric was taken to Palomar Medical Center from the scene of the accident, and complained of right shoulder and arm pain, as well as pain to his lower ribs and chest. He didn’t lose consciousness, but he did hit his head hard enough to crack his helmet. Several CT scans were taken which showed that Eric suffered a right clavicle fracture and a right inferior scapula fracture, as well as friction burns and multiple contusions to his chest, ribs and back.

Over the next two months Eric had several follow up visits with his orthopedic surgeon in Encinitas, and while his fractures did not require surgery, he was ordered to refrain from training for a significant period of time.

In the weeks after the accident, Eric sought the legal representation of Walton Law Firm, who has handled many bicycle accident cases. Eric wanted to focus on healing, and not have to deal with the insurance issues that follow accidents such as this. Upon taking over the case, Walton Law Firm promptly obtain the police report and spoke with the officer to confirm liability. It also put the relevant insurance company on notice that Eric was represented, and that all communications must be directed to the law firm.

As Eric healed, Walton Law Firm obtained all of his medical records and bills, and had them organized and reviewed by the firm’s in house nurse, preparing the records to be delivered to the insurance company with a demand for settlement. When Eric was nearly 100% recovered from his injury, Walton Law Firm prepared his settlement demand package, included all of his medical bills and records, information about lost wages, and a sizable sum for his general damages, which are the pain, suffering, inconvenience, etc. The accident caused a huge disruption in Eric’s life, especially his triathlon training. All of that information is included in the demand package.

The demand package was delivered to the insurance company, and after review, negotiations began. During those negotiations, the firm kept in close contact with Eric, and consulted with him along the way. When a settlement offer was finally made that satisfied Eric, the case was settled, Eric’s bills were paid, and he was able to walk away from the case with a large settlement sum.
