But when you look past the label, it becomes clear that this measure does the opposite. <p>As <a href="https://www.sacbee.com/opinion/op-ed/article315092081.html">explained </a>by Dean Erwin Chemerinsky, the initiative is not about helping victims. It is about shielding corporations and insurance companies from liability by making it harder for injured individuals to bring claims.</p>



<h2 class="wp-block-heading" id="h-the-real-target-contingency-fees">The Real Target: Contingency Fees</h2>



<p>At the heart of this proposal is a restriction on contingency fees. Currently, most personal injury cases operate on a contingency basis. That means the lawyer only gets paid if there is a recovery, typically taking 30 to 40 percent of the result.</p>



<p>This system is not a loophole. It is the only reason everyday people can hire experienced trial lawyers. <strong>Without it, most injury victims simply could not afford representation</strong>.</p>



<p>The initiative would effectively cap contingency fees at 25 percent or less, and worse, it appears to require that litigation costs and medical expenses come out of that same limited portion.</p>

<p>The consequences are not theoretical. Even the California Attorney General’s office has recognized that this type of measure would lead to fewer cases being filed on behalf of injured victims.</p>



<p>When fewer cases are filed, negligent drivers, corporations, and insurers face less accountability. That shifts the balance of power dramatically away from injured individuals and toward large companies with deep resources.</p>



<p>In other words, the people who benefit most are not victims. They are defendants.</p>



<h2 class="wp-block-heading" id="h-a-familiar-playbook-micra">A Familiar Playbook: MICRA</h2>



<p>If this sounds familiar, it should. California has seen this before with the Medical Injury Compensation Reform Act, which capped damages in medical malpractice cases for decades.</p>



<p>MICRA made it extremely difficult for injured patients to find lawyers. Cases that were too complex or costly simply were not taken. Victims with legitimate claims were left without recourse, not because their cases lacked merit, but because the economics no longer made sense.</p>



<p>Only recently were those limits adjusted after years of criticism and demonstrated harm to patients.</p>



<p>The Uber initiative follows the same blueprint. Limit recovery and restrict attorney compensation, and you effectively close the courthouse doors to many victims.</p>

<p>In October 2025, the governor signed a new law that would allow local authorities to lower the speed limit in school zones to a level below the previously existing 25 miles per hour.</p>



<p>That law, <a href="https://leginfo.legislature.ca.gov/faces/billNavClient.xhtml?bill_id=202520260AB382">Assembly Bill 382</a>, authorizes a local authority, by ordinance or resolution, to lower a school zone speed limit to 20 miles per hour, down from 25 miles per hour. The law runs through January 1, 2031, at which time the speed limit will be reduced to a prima facie speed limit of 20 miles per hour in all school zones in California.</p>

In short, before we get into the details of the new law, it is important to understand just how dangerous speeding is. According to the National Safety Council (NSC), “speeding is a major factor in traffic deaths and injuries” on all road types, and particularly on roads where higher speeds are permitted. Speeding is cited as a factor in about 30 percent of all traffic deaths annually, and younger drivers are at greater risk of being involved in a speeding-related <a href="https://www.sandiegoaccidentinjurylawyer.com/">crash </a>or fatality.</p>



<p>Many serious and deadly collisions in which speeding is a factor also involve impaired driving, and a high percentage occur on freeways or highways, but can also occur on local roads. Statistically, male drivers are involved in nearly double the number of speeding-related collisions as female drivers. As the NSC suggests, where speeds are reduced, the chances of a severe or deadly collision are also reduced.</p>



<h2 class="wp-block-heading" id="h-learning-more-about-ab-1014-and-the-reduction-of-speeds-on-highways-and-freeways">Learning More About AB 1014 and the Reduction of Speeds on Highways and Freeways</h2>



<p>Acknowledging the need for a reduction in speeds on California highways,<a href="https://calmatters.digitaldemocracy.org/bills/ca_202520260ab1014"> Assembly Bill 1014</a>, which was approved by Governor Gavin Newsom on October 3, 2025, took effect on January 1, 2026. In sum, the law authorizes the California Department of Transportation (DOT) to reduce speed limits by five miles per hour on state highways following research that shows even a reduction in speed by five miles per hour can make a difference in the severity of collisions.</p>



<p>More specifically, under AB 1014, lawmakers clarify that, prior to the bill, the existing law required the DOT “to require speed limits to be rounded up or rounded down to the nearest five miles per hour of the 85th percentile of free-flowing traffic,” and authorized local authorities “to additionally lower the speed limit in certain circumstances.” The newly enacted law authorizes the DOT to additionally lower the speed limit in circumstances “if it finds the speed limit derived from the 85th percentile to be higher than reasonable or safe.” In such circumstances, the DOT can reduce the speed limit by an additional 5 miles. In addition, the law allows local authorities to set speed limits of 20 miles per hour or 25 miles per hour on specified highways.</p>

<p>During the fall, according to the data reported in the <em><a href="https://www.sciencedirect.com/science/article/abs/pii/S0022437522001141">Journal of Safety Research</a></em>, the autumn time change results in a 15% increase in freeway accidents, a 9% increase in intersection collisions, a 12% increase in urban traffic crashes, and an increase in dusk and nighttime crashes by nearly 30%. <p>In 2018, Amazon launched its Delivery Service Partner (DSP) program. Instead of employing drivers directly, Amazon contracts with thousands of small delivery companies that operate Amazon-branded vans. These DSPs employ hundreds of thousands of drivers worldwide, but they exist almost entirely to serve Amazon.</p>



<p>On paper, Amazon says these drivers are not its employees. By labeling them as “independent contractors” working for separate businesses, Amazon tries to distance itself from crashes. DSP contracts even require these small companies to defend Amazon in lawsuits and carry liability coverage—often capped at $1 million, which can be insufficient in cases of catastrophic injury.</p>



<h2 class="wp-block-heading" id="h-the-reality-amazon-maintains-control">The Reality: Amazon Maintains Control</h2>



<p>While Amazon denies responsibility, courts and injured victims see a different picture. Amazon sets the rules for who can be hired, requires drivers to take its training courses, controls delivery routes through its apps, and even tracks drivers’ speed, braking, and on-time performance. DSPs face penalties if deliveries are late, which can pressure drivers to speed or take risks.</p>



<p>Amazon also reserves the power to ban drivers it deems unsafe, effectively ending their employment. With this level of oversight, many judges and juries have found that Amazon behaves less like a hands-off client and more like a joint employer.</p>

<p>Across the country—and increasingly in California—courts are rejecting Amazon’s argument that it bears no responsibility. For example, in cases where Amazon’s strict quotas and tracking systems contributed to dangerous driving, judges have allowed lawsuits against Amazon to proceed. The trend is clear: if a company controls nearly every aspect of a driver’s work, it can’t avoid accountability when negligence occurs.</p>

<p>Over the last two decades, cycling as a mode of transportation and recreation has risen for youth and young adults in urban areas, including cities in <a href="https://www.sandiegoaccidentinjurylawyer.com/bicycle-accidents.html">San Diego</a> County. With the increase in bicycling, children and young adults aged 15 to 39 years old have experienced decreasing rates of cardiovascular disease and other conditions associated with poor health and obesity, according to an article in the journal Frontiers in Public Health. At the same time, however, as disease rates have decreased, the increased use of cycling for both transportation and recreation has resulted in a rise in cyclist road injuries among this age group. It is important to understand the risk of injury due to an accident, and the ways in which it may be possible to seek compensation.</p>



<h2 class="wp-block-heading" id="h-rising-rates-of-road-injuries-among-youth-and-young-adult-cyclists">Rising Rates of Road Injuries Among Youth and Young Adult Cyclists</h2>



<p>With more cyclists on the roads over the last twenty years, injury rates in accidents and collisions have risen. Whether the reduction in disease rates outweighs these injury rates is something that must be studied further, the authors of the recent article suggest. Yet their research does show that cyclist road injuries have become a cause for serious concern. The study reported in <em><a href="https://www.frontiersin.org/journals/public-health/articles/10.3389/fpubh.2025.1581789/full">Frontiers in Public Health</a></em> reveals that cyclists between the ages of 15 and 39 currently “face twice the risk of fatal injuries per mile compared to automobiles passengers,” and that “the likelihood of sustaining a fatal injury while cycling is 12 times greater than while driving a car.”</p>



<p>According to the National Highway Traffic Safety Administration (NHTSA), more than 1,100 people are killed in bicycle collisions with automobiles every year, and that number does not account for deaths that result from other types of bicycle accidents. Thousands more cyclists sustain fatal injuries.</p>

<p>Construction sites are inherently dangerous, but when companies fail to follow long-established safety rules, those dangers become deadly. That’s exactly what happened to 27-year-old <a href="https://thecoastnews.com/construction-firm-fined-157-5k-over-fatal-scripps-ranch-trench-collapse/">Joel Olea Gomez</a> of San Marcos, who tragically lost his life in a preventable trench collapse at a Scripps Ranch job site in August.</p>



<p>Joel was working for W.A. Rasic Construction, a Long Beach-based company hired for a water-system project at Hoyt Park Drive and Scripps Ranch Boulevard. At around 3 a.m., he was inside a 17-foot-deep trench that lacked basic safety protections like shoring or trench boxes. Without those safeguards, the trench caved in, burying Joel under tons of earth and a large concrete pipe. A second worker in the trench managed to escape, but Joel died at the scene. His body was recovered only after emergency crews spent over four hours stabilizing the site to prevent additional collapses.</p>



<p>In the aftermath, the California Division of Occupational Safety and Health (Cal/OSHA) investigated and fined the company $157,500. According to the citations, W.A. Rasic Construction failed on multiple fronts: they didn’t inspect the site properly, failed to train workers, and neglected to implement a required injury-and-illness prevention program that’s been mandated for over 30 years. Most critically, they failed to provide adequate cave-in protection—something Cal/OSHA deemed a “critical lapse.”</p>

<p>Team managers and coaches are primarily tasked with keeping track of head injuries among tackle football players between the ages of 5 and 14, but those reports have proven incomplete, according to a recent study. Among older football players, athletic trainers are tasked with keeping close track of brain injuries, and the study suggests that younger players also need athletic trainers. That recommendation has been echoed by the American Academy of Pediatrics. As a press release on the new study underscores, “without a medical professional on the sidelines, it is likely that some child players with concussions go undiagnosed.”</p>
