Whether you were injured in a motor vehicle collision in Vista or elsewhere in North County, there is a good chance that the crash resulted from a negligent motorist’s behavior behind the wheel. While negligence can take many forms, including impaired driving and distracted driving, speeding remains one of the leading causes of motor vehicle crashes in California and throughout the country. According to the National Highway Traffic Safety Administration (NHTSA), nearly 12,000 people were killed in speeding-related crashes in 2024 alone. Speeding is cited as a contributing factor in almost 30% of all fatal traffic collisions, and it plays a role in many nonfatal accidents as well.

For purposes of liability and seeking compensation through a car accident claim, what counts as speeding? In other words, does a negligent motorist need to be caught driving at a speed beyond the posted speed limit? In this blog post, we’ll explore these questions and provide insights into liability in speeding-related crashes, especially in the Vista area.

Understanding Speeding and Its Causes in North County San Diego

According to the NHTSA, speeding is classified as a form of aggressive driving and results from various driver behaviors. Not all speeding drivers are reckless; some may be responsible in other areas of driving but may occasionally exceed speed limits. The NHTSA highlights several common reasons for the increase in speeding-related crashes:

Increasing Traffic and Road Congestion: As more vehicles occupy the roads, drivers may feel pressured to speed to keep up with the flow of traffic.

Running Late: Whether heading to work, school, or an appointment, the urgency to arrive on time often leads drivers to exceed safe speed limits.

Anonymity in Vehicles: Drivers often feel less accountable for their actions when encased in a vehicle, leading to riskier behaviors like speeding.

Disregard for Safety: Some drivers do not prioritize the safety of others, ignoring traffic laws and posted speed limits.

When a driver speeds for any of the above reasons, they may be liable for injuries resulting from a speeding-related collision. Understanding these motivations can help victims comprehend the context of their accidents and the behaviors of the drivers involved.

Speeding and the Posted Speed Limits

Does speeding always mean driving at a speed beyond the posted speed limit? Legally speaking, if a motorist is traveling above the posted speed limit, they are considered speeding and can be held liable for any resulting collisions and injuries. However, speeding can also occur in situations where a driver is at or below the posted speed limit but is still driving too fast for the conditions.

Conditions Affecting Speeding Liability

According to a study from the Federal Highway Administration (FHWA) and the U.S. Department of Transportation, inclement weather can lead to different forms of driver negligence and speeding. When conditions are poor—whether from heavy fog, strong winds, or heavy rain—drivers must adjust their speed to ensure safety. Many motorists neglect to do this, which can lead to accidents.

In such cases, a driver may be “speeding” under the circumstances even if they are technically within the posted speed limit. For example, if a driver is traveling at 45 mph in a 50 mph zone during a heavy rainstorm, their speed may still be considered too fast for the conditions. Consequently, they may be held liable for any injuries resulting from a crash, as they failed to exercise reasonable care.

Seeking Compensation After a Speeding-Related Accident

Were you injured in a car accident caused by a speeding motorist? If so, you may be entitled to financial compensation through a third-party auto insurance claim or a civil lawsuit against the negligent driver. Understanding the complexities of liability in speeding cases is crucial for building a strong case.

The Role of a Vista Personal Injury Lawyer

Navigating the legal process after a car accident can be overwhelming, especially when trying to determine fault and liability. This is where a Vista personal injury lawyer can be invaluable. They can help you understand your rights, gather essential evidence, and represent your interests against insurance companies or in court.

Gathering Evidence: A skilled attorney can collect police reports, witness statements, and expert testimonies to establish the liability of the speeding driver.

Negotiating with Insurance Companies: Insurance companies often try to minimize payouts, and having a lawyer can help you negotiate a fair settlement.

Filing Legal Claims: If necessary, your lawyer can guide you through the process of filing a civil lawsuit, ensuring that you meet all legal deadlines and requirements.

Why Choose a Vista Personal Injury Lawyer?

Choosing a local attorney familiar with the laws and regulations in Vista can significantly enhance your chances of a successful claim. They understand the local courts, the common tactics used by insurance companies, and how to effectively argue your case.

Conclusion

In conclusion, understanding what counts as speeding for liability purposes is crucial for anyone involved in a car accident. Speeding is not solely defined by exceeding posted speed limits; it also includes driving too fast for prevailing conditions. If you or a loved one has been injured by a speeding motorist, don’t hesitate to reach out to a Vista personal injury lawyer.
A new proposed ballot initiative backed by Uber is being marketed as a reform designed to “protect” automobile accident victims. But when you look past the label, it becomes clear that this measure does the opposite. It would fundamentally undermine the ability of injured people to find legal representation and hold wrongdoers accountable.

As explained by Dean Erwin Chemerinsky, the initiative is not about helping victims. It is about shielding corporations and insurance companies from liability by making it harder for injured individuals to bring claims.

The Real Target: Contingency Fees

At the heart of this proposal is a restriction on contingency fees. Currently, most personal injury cases operate on a contingency basis. That means the lawyer only gets paid if there is a recovery, typically taking 30 to 40 percent of the result.

This system is not a loophole. It is the only reason everyday people can hire experienced trial lawyers. Without it, most injury victims simply could not afford representation.

The initiative would effectively cap contingency fees at 25 percent or less, and worse, it appears to require that litigation costs and medical expenses come out of that same limited portion.

The practical result is obvious. There would often be little to no compensation left for attorneys. And when lawyers cannot afford to take cases, those cases simply do not get brought.

Fewer Cases, Less Accountability

The consequences are not theoretical. Even the California Attorney General’s office has recognized that this type of measure would lead to fewer cases being filed on behalf of injured victims.

When fewer cases are filed, negligent drivers, corporations, and insurers face less accountability. That shifts the balance of power dramatically away from injured individuals and toward large companies with deep resources.

In other words, the people who benefit most are not victims. They are defendants.

A Familiar Playbook: MICRA

If this sounds familiar, it should. California has seen this before with the Medical Injury Compensation Reform Act, which capped damages in medical malpractice cases for decades.

MICRA made it extremely difficult for injured patients to find lawyers. Cases that were too complex or costly simply were not taken. Victims with legitimate claims were left without recourse, not because their cases lacked merit, but because the economics no longer made sense.

Only recently were those limits adjusted after years of criticism and demonstrated harm to patients.

The Uber initiative follows the same blueprint. Limit recovery and restrict attorney compensation, and you effectively close the courthouse doors to many victims.

The Misleading Narrative

Supporters of the initiative argue that limiting contingency fees will allow victims to keep more of their recovery. But this argument ignores a critical point.

A larger share of zero is still zero.

If an injured person cannot find a lawyer to take their case, they are far more likely to recover nothing at all. Studies have consistently shown that represented plaintiffs recover significantly more than those who try to navigate the system alone.

The initiative also takes aim at so-called “billboard attorneys,” suggesting that lawyers are the problem. But this framing is misleading. Personal injury lawyers provide a vital service by offering free consultations and advancing the costs of litigation so that injured individuals can pursue justice.

Without that system, access to the legal system becomes a privilege reserved for the wealthy.

Criminalizing Representation

Perhaps most concerning, the initiative introduces potential criminal penalties for attorneys who violate its fee structure.

This creates uncertainty and risk that will further discourage lawyers from taking cases. Even strong, meritorious claims may be declined simply because the financial and legal risks are too high.

Why This Matters

At its core, this initiative is about access to justice.

When someone is seriously injured, they are often facing mounting medical bills, lost income, and long-term consequences. The contingency fee system levels the playing field by allowing them to hire skilled counsel without upfront costs.

Take that away, and you tilt the system heavily in favor of corporations and insurers.

Standing Up for Injury Victims

At North County Injury Lawyers, we believe that every injured person deserves access to experienced, high-quality legal representation. The contingency fee model makes that possible. It ensures that your lawyer is fully invested in your case and only gets paid if you do.

Measures like this Uber-backed initiative threaten to dismantle that system.

If you or a loved one has been injured, having the right advocate matters. Our team is committed to protecting your rights, holding wrongdoers accountable, and making sure you are not pushed out of the legal system when you need it most.

Because justice should not depend on what you can afford upfront.

School zones are among the most devastating places for pedestrian accidents to occur in Oceanside and elsewhere in the North County region. Children and teenagers, as well as faculty, staff, and administrators, can be struck by motor vehicles that fail to adhere to school zone speed limits when they are getting off the bus or heading into school from their vehicles, or when motorists speed through crosswalks without stopping to look for pedestrians. Pedestrians, often younger children, who wait for school buses at bus stops can also be particularly susceptible to pedestrian injuries caused by negligent motorists.

What should you know about school zone pedestrian safety in Oceanside? Our North County personal injury lawyers can tell you more about pedestrian accidents around school zones in general, as well as more about a recently passed law in California that is designed to reduce these types of collisions and injuries by allowing for lower speed limits.

School Zone Pedestrian Safety and Accidents

According to a recent study reported by Safe Kids, school zone pedestrian risks affect students of all ages, as well as faculty and staff who work at the schools. These are areas where there is significant pedestrian traffic, typically from 500 to 1,000 feet from the boundary of a school. Collisions involving pedestrians and motor vehicles can occur in crosswalks, on roads around the school outside crosswalks, parent pickup areas, school bus lanes, and even in areas in and adjacent to parking lots. Teens, in particular, have been involved in a rising number of pedestrian accidents and injuries in school zones in recent years.

Motorists have a duty to pedestrians and must slow down according to the speed limit and drive as a reasonably safe person would in a school zone. Pedestrians can also take steps to stay safe, including crossing at crosswalks, looking twice before crossing the street, and avoiding distractions while walking. According to the Safe Kids report, the likely cause of rising teen pedestrian accidents in school zones is distraction — texting or otherwise looking down at a phone while crossing the street.

New California Law Could Reduce Rate of Pedestrian Injuries in School Zones

In October 2025, the governor signed a new law that would allow local authorities to lower the speed limit in school zones to a level below the previously existing 25 miles per hour.

That law, Assembly Bill 382, authorizes a local authority, by ordinance or resolution, to lower a school zone speed limit to 20 miles per hour, down from 25 miles per hour. The law runs through January 1, 2031, at which time the speed limit will be reduced to a prima facie speed limit of 20 miles per hour in all school zones in California.

If you or someone you love suffered a catastrophic injury in a Carlsbad accident caused by another person’s negligence, can you be eligible for additional compensation? We often hear about “catastrophic” injuries that result in serious and permanent disabilities, but it can be difficult to know precisely what the term means and how it affects damages in a personal injury lawsuit. In short, you may be eligible for higher compensation after a more serious accident, including one in which catastrophic injuries occurred, and our Carlsbad personal injury and wrongful death attorney can explain in more detail.

What is a Catastrophic Injury?

What counts as a “catastrophic” injury? Depending on who you ask, the definitions can be slightly different. According to Merriam-Webster, an injury that is “catastrophic” is one that has resulted from a catastrophe, defined as “a momentous tragic event.” Yet that definition is not very specific, especially when it comes to questions of liability and damages after catastrophic injuries arising out of accidents.

The National Center for Catastrophic Sport Injury Research provides a more specific definition, indicating that catastrophic injuries are best defined as “fatalities, injuries that result in permanent functional disability, and serious injuries that result in temporary functional disability with full recovery.” In other words, a catastrophic injury can be one that always results in some type of functional disability, though the outcome can range from full recovery to death. That Center cites the following as commonly occurring examples of catastrophic injuries:

● Spinal cord injuries (SCIs);
● Brain bleeds;
● Skull fractures and other traumatic brain injuries (TBIs);
● Heat stroke;
● Sudden cardiac arrest;
● Internal organ injuries.

Calculating Damages for Catastrophic Injuries

While there is no specific statute addressing catastrophic injuries as opposed to other severities of physical and emotional harm, plaintiffs who file claims for catastrophic injuries may be eligible for higher damages awards based on California’s compensatory damages law, which allows injury victims to obtain different types of compensatory damages that are designed to compensate them for both objective monetary losses and subjective non-monetary losses that have resulted from their injuries.

Under California law, a plaintiff or claimant can be eligible for compensatory damages that include economic and non-economic damages. Since a catastrophic injury typically results in significantly greater economic damages (such as hospital bills, other medical care, and rehabilitation), as well as greater non-economic damages (such as loss of enjoyment of life, or pain and suffering), catastrophic injuries typically do result in more substantial or higher damages awards in a personal injury or wrongful death claim.

If you have been injured and are wondering what your case is worth, you are not alone. It is usually the first question people ask. It is also one of the most difficult to answer early on. There is no universal formula, no reliable calculator, and no shortcut that produces an accurate number. The value of a personal injury case depends on a combination of factors that have to be evaluated together.

That said, understanding how cases are generally valued can help you make sense of the process and avoid some common misconceptions.

Understanding the two types of damages

Every personal injury case is built on two categories of damages: economic and non economic.

Economic damages are the measurable financial losses. These include medical bills, lost wages, future medical care, and any other out of pocket expenses related to the injury. These numbers are straightforward because they can be supported with records and documentation.

Non economic damages are different. These include pain, suffering, emotional distress, loss of enjoyment of life, and the overall impact the injury has had on your day to day existence. There is no receipt for these losses, which makes them more subjective. This is where the true story of your injury matters.

Why there is no fixed formula

You may have heard that personal injury cases are valued by multiplying medical bills by some number. While this idea is often repeated, it is overly simplistic and frequently wrong.

The reality is that not all medical bills are treated equally. A large bill does not automatically mean a valuable case, and a smaller bill does not mean the opposite.

For example, diagnostic testing like MRIs or CT scans may generate significant charges. But if those tests do not show any injury, they may carry less weight in terms of overall case value. On the other hand, bills tied to meaningful treatment, like physical therapy, injections, or surgery, tend to matter more because they reflect actual injury and recovery efforts.

At the same time, there are serious injuries that may not come with enormous medical bills but are still clearly high value. An amputation is a good example. Even if the initial treatment costs are relatively contained, the lifelong impact of that injury is profound. That type of case is valued based on the permanent loss and life changes, not just the bills.

What really drives case value

When experienced personal injury attorneys evaluate a case, they are looking beyond just the numbers. They are looking at the full picture.

The severity of the injury is often the most important factor. Minor soft tissue injuries typically resolve and carry lower value. More serious injuries like fractures, disc injuries, or those requiring surgery increase value. Permanent or life altering injuries increase it significantly.

The quality and consistency of medical treatment also matters. Cases with prompt care, consistent follow up, and clear documentation tend to be stronger. Gaps in treatment or unexplained delays can raise questions and reduce value.

Liability plays a major role as well. Even a serious injury can be discounted if fault is unclear or disputed. In California, if you are partially at fault, your recovery can be reduced based on your percentage of responsibility.

Another key factor is how the injury has affected your daily life. If you can no longer work the same job, participate in activities you once enjoyed, or care for your family in the same way, those changes matter. The more your life has been disrupted, the more significant your non economic damages tend to be.

Finally, credibility is critical. Your complaints need to align with your medical records and your treatment history. Consistency and honesty go a long way in increasing the perceived value of a case.

Why similar cases can have very different outcomes

Two cases that look similar on paper can have very different values.

One person may have high medical bills but little objective evidence of injury and minimal ongoing complaints. That case may resolve for a modest amount.

Another person may have moderate medical bills but strong imaging, consistent treatment, and clear limitations in daily life. That case may be worth significantly more.

And in catastrophic injury cases, the value may far exceed what the medical bills alone would suggest because of the long term consequences.

The bottom line

There is no single number that defines what your personal injury case is worth. It is not just about adding up bills or applying a multiplier. It is about understanding how the injury has affected your life and how well that impact can be demonstrated.

A proper evaluation takes experience, careful analysis, and a clear understanding of both the legal and human aspects of the case. If you are trying to understand the value of your claim, the best approach is to look at the full picture rather than relying on shortcuts.

The scenic stretches of the Coast Highway and the busy lanes of the I-5 corridor define life in North County San Diego. However, these beautiful routes often become the site of devastating collisions due to human error and driver negligence. Despite strict California hands-free laws, distracted driving remains a leading cause of injury in our local communities.

Whether you were commuting through Oceanside, heading to dinner in Carlsbad, or driving through the residential streets of Vista or San Marcos, a split second of a driver looking at a screen can change your life forever. Proving liability in these cases is essential for securing the compensation you deserve.

The Reality of Distracted Driving in North County

Distracted driving is a national crisis with local consequences. According to the Federal Communications Commission (FCC), more than 3,000 people are killed and approximately 325,000 are injured in traffic crashes annually in recent years. A staggering percentage of these incidents involve smartphone use.

In North County cities like Escondido and Encinitas, the density of traffic—combined with high speeds on the freeway—means that a driver who is texting is essentially driving blind for hundreds of feet at a time. When a motorist fails to behave in a reasonably safe manner, they become legally liable for the damages they cause to other vehicle occupants, motorcyclists, bicyclists, and pedestrians.

How to Prove a Driver Was Texting

Proving that a driver was texting at the exact moment of impact is more complex than simply stating it in a police report. Liability hinges on evidence. Here is how an experienced North County car accident attorney builds a case:

Securing Cell Phone Records
The most definitive way to prove distracted driving is to obtain data from the negligent motorist’s cell phone carrier. This data can provide a timestamped log of sent and received texts or data usage that aligns perfectly with the time of the crash.

Because this information is private, it typically requires a subpoena or court order. A skilled personal injury lawyer will handle the legal filings necessary to compel the service provider to release these records before they are purged.

Eyewitness Testimony
Often, other drivers on the road in Solana Beach or Del Mar may have noticed the defendant’s erratic behavior before the crash. If a witness saw the driver looking down at their lap or holding a glowing device, their testimony becomes a cornerstone of your liability claim.

Traffic and Surveillance Camera Footage
North County is increasingly monitored by traffic management systems and private security cameras. Footage from a “smart” intersection in Carlsbad or a storefront camera in Fallbrook can often capture the driver’s actions inside the cabin just moments before the collision.

Social Media Activity
In an era of “instant” posting, it is surprisingly common for distracted drivers to post to platforms like Instagram, TikTok, or X (formerly Twitter) while behind the wheel. If a post or “story” was published at the time of the accident, it serves as powerful digital evidence of negligence.

The Importance of the California Statute of Limitations

Time is of the essence when filing a claim in California. Under state law, the statute of limitations for most personal injury lawsuits arising from a car accident is two years from the date of the injury.

While two years may seem like a long time, the investigative process takes months. Evidence like dashcam footage can be overwritten, and witnesses’ memories of the event in Poway or Rancho Santa Fe can fade. Starting the process early ensures your attorney can preserve the evidence needed to win.

Seeking Full Compensation for Your Losses

Proving liability is the first step toward recovery. Once fault is established, you can seek compensation for:

Medical Expenses: Including emergency room visits, surgeries, and physical therapy.

Lost Wages: Compensation for time missed at work and any loss of future earning capacity.

Pain and Suffering: Non-economic damages for the physical and emotional toll of the crash.

Property Damage: Repairs to your vehicle or replacement costs.

Contact a North County San Diego Car Accident Lawyer

If you were injured by a distracted driver in Oceanside, Carlsbad, Vista, San Marcos, Escondido, or any surrounding North County area, you shouldn’t have to shoulder the financial burden alone.

Holding a negligent driver accountable requires a combination of local knowledge and aggressive legal advocacy. Often, insurance companies will attempt to settle for less than your case is worth; having a lawyer to negotiate on your behalf ensures you are treated fairly.

Whether you are traveling through Valley Center to reach the I-15 or another area of North County before getting onto a highway, it is important to know about a new law that takes effect in 2026 to reduce speeding-related accidents in California by reducing speed limits. The law is primarily aimed at highways and freeways where travel at higher speeds occurs, but it could have further-reaching effects among drivers.

Speeding as a Serious Risk Factor in Motor Vehicle Crashes in California

Why is there a need to reduce speed limits on California freeways or highways more generally? In short, before we get into the details of the new law, it is important to understand just how dangerous speeding is. According to the National Safety Council (NSC), “speeding is a major factor in traffic deaths and injuries” on all road types, and particularly on roads where higher speeds are permitted. Speeding is cited as a factor in about 30 percent of all traffic deaths annually, and younger drivers are at greater risk of being involved in a speeding-related crash or fatality.

Many serious and deadly collisions in which speeding is a factor also involve impaired driving, and a high percentage occur on freeways or highways, but can also occur on local roads. Statistically, male drivers are involved in nearly double the number of speeding-related collisions as female drivers. As the NSC suggests, where speeds are reduced, the chances of a severe or deadly collision are also reduced.

Learning More About AB 1014 and the Reduction of Speeds on Highways and Freeways

Acknowledging the need for a reduction in speeds on California highways, Assembly Bill 1014, which was approved by Governor Gavin Newsom on October 3, 2025, took effect on January 1, 2026. In sum, the law authorizes the California Department of Transportation (DOT) to reduce speed limits by five miles per hour on state highways following research that shows even a reduction in speed by five miles per hour can make a difference in the severity of collisions.

More specifically, under AB 1014, lawmakers clarify that, prior to the bill, the existing law required the DOT “to require speed limits to be rounded up or rounded down to the nearest five miles per hour of the 85th percentile of free-flowing traffic,” and authorized local authorities “to additionally lower the speed limit in certain circumstances.” The newly enacted law authorizes the DOT to additionally lower the speed limit in circumstances “if it finds the speed limit derived from the 85th percentile to be higher than reasonable or safe.” In such circumstances, the DOT can reduce the speed limit by an additional 5 miles. In addition, the law allows local authorities to set speed limits of 20 miles per hour or 25 miles per hour on specified highways.

High school sports are a cornerstone of student life in Poway and across North County. While these programs build character and fitness, they also carry inherent physical risks. When a student-athlete suffers a debilitating injury—such as a traumatic brain injury (TBI) or a severe fracture—parents often find themselves wondering: Is the school responsible, or did my child “sign away” their rights by playing?

Understanding school liability in California requires navigating a complex legal landscape, particularly the defense known as the Assumption of Risk.

Overcoming the “Assumption of the Risk” Doctrine

In California, most sports-related lawsuits face a significant hurdle: Primary Assumption of Risk. This legal doctrine suggests that by choosing to participate in a sport, the athlete (and their parents) accepts the inherent dangers of that activity. For example, a soccer player assumes the risk of an accidental collision.

However, this is not a “get out of jail free” card for schools. To hold a school or district liable, we must demonstrate that the school’s conduct increased the risk of injury beyond what is inherent to the sport. Examples of overcoming this doctrine include:

Failure to Supervise: Coaches failing to monitor drills or allowing “hazing” rituals.

Defective Equipment: Providing helmets or pads that are outdated or broken.

Environmental Hazards: Forcing students to play on unsafe surfaces (e.g., fields with hidden holes or extreme heat without water breaks).

Gross Negligence: Pushing an athlete to perform a maneuver that is clearly beyond their skill level or dangerous for their age group.

The Role of Athletic Trainers and Concussion Protocols

Research indicates that high schools with certified athletic trainers on staff see significantly fewer injuries. While trainers are a vital safety net, their presence (or absence) can also be a focal point of liability:

Failure to Diagnose: If a trainer or coach fails to recognize signs of a concussion and returns the student to play, the school may be liable for “Second Impact Syndrome” or aggravated TBI.

Statutory Violations: California law (such as AB 2127) strictly regulates how schools handle concussions. If a school fails to follow these mandatory protocols, the Assumption of Risk defense often crumbles.

High-Risk Sports: By the Numbers

According to the CDC, certain sports carry a disproportionate share of the risk for emergency room visits and TBIs:

Sport Category

Primary Risks

Boys’ Tackle Football

Highest rate of head impacts and overall injuries.

Girls’ Soccer

Leading cause of concussions in female athletics.

Wrestling & Lacrosse

High frequency of fractures and TBIs.

Basketball

Common site for ligament tears and floor-impact injuries.

Holding Schools Accountable in Poway

If your child was injured, the school district may argue that the injury was “just part of the game.” Our job is to prove otherwise. Whether it was a coach ignoring a heat warning, a trainer failing to pull a dizzy player from the field, or a district failing to maintain its facilities, these are not “inherent risks”—they are negligence.

Contact North County Injury Lawyers Today

If your child sustained a serious injury while playing school sports in Poway, don’t assume you have no recourse. We can help you evaluate the facts and determine if the school increased the risks to your child.

Would you like me to draft a checklist of questions you should ask your child’s coach or trainer following an injury to help document the incident?

If you have been injured in a car accident in North County San Diego, choosing the right personal injury lawyer can have a major impact on your recovery, your finances, and your peace of mind. From congested freeway collisions on Interstate 5 to intersection crashes along Coast Highway 101 or Mission Avenue, accidents happen every day in communities like Oceanside, Carlsbad, Encinitas, Vista, San Marcos, Fallbrook, Bonsall, and Escondido.

When you are dealing with injuries, medical bills, missed work, and insurance adjusters calling nonstop, knowing how to find a quality personal injury lawyer in North County San Diego is critical.

Why choosing the right personal injury lawyer matters

Not all personal injury cases are the same, and not all law firms approach them the same way. Car accident cases in North County often involve complex issues like disputed fault, multiple insurance policies, uninsured or underinsured drivers, or injuries that worsen over time.

A quality personal injury lawyer does more than submit paperwork. They investigate the crash, gather evidence, work with medical providers, and protect you from insurance tactics designed to minimize your claim.

Consider a common local scenario. A driver is rear ended at a stoplight in Oceanside near the 76 during rush hour. At first, they feel sore but decline an ambulance. Days later, neck and back pain worsen, and imaging shows disc injuries. The insurance company argues the injuries are minor or pre existing. Without an experienced lawyer who understands how these cases develop, victims are often pressured into low settlements that do not cover future care.

Look for local experience in North County San Diego

When searching for a personal injury lawyer, local experience matters. North County San Diego has its own traffic patterns, accident hotspots, medical providers, and courts. A lawyer who regularly handles cases in this region understands those dynamics.

Car accidents frequently occur:

Along I-5 through Oceanside, Carlsbad, and Encinitas

On Highway 78 through Vista and San Marcos

At busy intersections in Escondido and Fallbrook

On coastal roads like Coast Highway 101

A lawyer familiar with North County knows how to obtain traffic camera footage, locate nearby witnesses, and work with local medical professionals who treat accident related injuries.

What to look for in a quality personal injury law firm

When interviewing personal injury lawyers in North County San Diego, focus on substance, not salesmanship. A strong firm should be able to clearly explain how they handle car accident cases from start to finish.

Key qualities to look for include:

Experience handling car accident and injury cases specifically

A clear investigation plan, including police reports and evidence collection

Willingness to deal directly with insurance companies on your behalf

Relationships with trusted medical providers

A track record of results, not just quick settlements

Transparent contingency fee arrangements

Be cautious of firms that guarantee outcomes or push you to settle quickly before the full extent of your injuries is known. Quality representation prioritizes long term recovery, not short term payouts.

Pay attention to how the firm communicates

Communication is often overlooked, but it is one of the most important aspects of a personal injury case. After a car accident, clients need updates, explanations, and honest guidance.

A quality personal injury lawyer should:

Return calls and emails promptly

Explain legal concepts in plain language

Prepare you for what to expect at each stage

Treat your case as important, not routine

If you feel rushed or dismissed during an initial consultation, that experience is unlikely to improve later.

Why car accident cases require focused attention

Car accident cases make up a large portion of personal injury claims, but that does not mean they are simple. Insurance companies often dispute fault, downplay injuries, or argue that treatment was unnecessary.

In North County San Diego, accidents involving commuters, tourists, cyclists, and motorcyclists add layers of complexity. A quality lawyer knows how to handle cases involving serious injuries such as traumatic brain injuries, spinal injuries, fractures, and soft tissue damage that can become chronic.

A trusted option for North County residents: North County Injury Lawyers

For more than 20 years, North County Injury Lawyers has been representing injured residents throughout North County San Diego in personal injury and car accident cases.

What sets the firm apart is its deep local connection. All of the attorneys live in North County and are part of the communities they serve. They understand the roads their clients drive, the intersections where accidents happen, and the challenges local families face after an injury.

North County Injury Lawyers has been voted Best Personal Injury Law Firm two years in a row, reflecting the trust and confidence of the community. The firm’s attorneys have also earned individual recognition, including selection to Super Lawyers and Best Lawyers in America, honors awarded to attorneys who demonstrate excellence in their field.

Rather than treating cases as files, the firm focuses on personal, hands on representation. That means taking the time to understand each client’s injuries, losses, and goals before pursuing compensation.

Taking the next step after an accident

If you have been injured in a car accident in Oceanside, Carlsbad, Encinitas, Vista, San Marcos, Escondido, Fallbrook, or anywhere in North County San Diego, do not wait to get legal advice. Evidence can disappear, and insurance companies move quickly to protect themselves.

Finding a quality personal injury lawyer in North County San Diego is about choosing experience, integrity, and local knowledge. With the right legal team, you can focus on healing while your lawyer focuses on holding the responsible parties accountable and securing the compensation you deserve.

Crash test dummies have been used in determining motor vehicle safety for Poway and other California residents since the 1970s, and the use of these objects has led to vast improvements in vehicle safety that have helped to prevent severe injuries in car accidents. Yet for more than 50 years, crash test dummies have only been modeled on male bodies, thus failing to take into account the types of injuries sustained by adult female vehicle occupants. According to a recent report from The Guardian, the “first crash test dummy in the US modeled specifically on female anatomy” has just arrived at the US Department of Transportation. As the article notes, now that crash test dummies are considering vehicle impacts and injuries to both male and female occupants alike, American officials expect to “close decades of safety gaps in vehicle testing.”

Given that studies suggest female vehicle occupants are “73% more likely than men to sustain serious injuries in a crash,” it is about time that researchers began addressing the types of car accident injuries that tend to affect women and alter their lives. Our Poway car accident lawyers can tell you more.

What is Different About a Female Crash Test Dummy?

For decades, researchers have known that female vehicle occupants suffer more serious injuries than men in many crashes, and they tend to suffer particular types of injuries. More specifically, female vehicle occupants are much more likely to sustain injuries to their pelvis or liver, which can often result in serious mobility issues and can be life-threatening. Despite this knowledge, for decades, the crash test dummy used to assess vehicle safety has been coded as “male,” a model that is based on a 5’9” man weighing over 170 pounds.

The new “female” crash test dummy is based instead on a typical female body to “ultimately enable better assessment of brain, thorax, abdominal, pelvic, and lower leg injury risk for small female occupants,” according to the report. The United States has moved to use this new female crash test dummy after several other countries have adopted similar models over the decade, such as Sweden and Australia.

Regardless of whether the automobile in which you were injured was designed with the safety of female occupants in mind, you may be able to file a Poway personal injury lawsuit against the negligent party who caused the collision and your resulting injuries.

Often, people injured in car accidents in Southern California will begin the process of seeking compensation by filing an auto insurance claim. If the insurance company cannot or will not provide a fair settlement — which is somewhat common — you can move onto filing a personal injury lawsuit against the at-fault driver or any other liable parties. Under California law, most car accident lawsuits must be filed within two years from the date of the crash. Discussing the matter with a qualified Poway personal injury lawyer is recommended.

For years, marijuana has been legal to use recreationally in Escondido and throughout California. Just because it is legal, similar to alcohol for adults aged 21 and older, does not mean that it is necessarily safe to drive during or after using it. Indeed, many people who use THC products can become impaired and may not be able to drive safely. When a motorist has been using marijuana or other THC-containing products and decides to drive, if that motorist causes an accident due to impairment and drugged driving, they can be liable for any injuries they cause to other occupants of their vehicle, motorists involved in the collision, and pedestrians or bicyclists involved in the crash. Our Escondido personal injury lawyer can tell you more.

New Study Shows a High Rate of THC in Fatal Car Accidents

While California does not have a “per se” amount or limit of THC in a person’s system that is illegal for driving, being impaired by THC can render a motorist liable for injuries in a crash. And THC impairment is more common than you might think.

A recent study published by the American College of Surgeons reveals that more than 40 percent of fatal motor vehicle crashes involve a THC-impaired driver who recently used a cannabis product. The study emphasizes that, while cannabis may be shown to have certain benefits to users in some circumstances, it remains dangerous to drive while under the influence of a THC-containing product.

Seeking Damages from a Driver Under the Influence of THC

To be clear, in California, recreational marijuana use and cannabis possession are lawful, but it is not legal to drive if you are impaired by cannabis or a THC-containing product.

Under California law, if a driver who was under the influence of THC or any other drug caused a crash in which you were injured, you may be able to seek compensatory damages from that driver by filing a personal injury lawsuit. Damages can include two types of compensatory damages: economic damages (which compensate you for direct, economic losses such as your medical bills or your lost wages), and non-economic damages (which can compensate you for indirect and subjective losses, such as your pain and suffering).

Contact Our Escondido Personal Injury Attorneys for Assistance with Your Car Accident Claim

Were you injured in a collision caused by a driver under the influence of marijuana? Although marijuana is legal for recreational use in California, as we discussed above, that does not mean that a driver can get behind the wheel of a motor vehicle while they are impaired. A driver who is under the influence of drugs or alcohol, even if they initially used those drugs or alcohol legally, can be liable for the harm they have caused. You may be eligible to receive a range of damages to help compensate you for your losses, and one of our experienced Escondido personal injury lawyers can assist you with your case.

In the first years of the COVID-19 pandemic, researchers observed significant changes in animal behavior that directly impacted dog bite trends in America and across the globe. Many people who had never considered owning a pet adopted a dog for companionship during stay-at-home orders. Even those who had considered pet ownership a distant goal accelerated their plans, adopting cats and dogs in record numbers.

Simultaneously, the shift to remote work meant California residents spent more time at home with their pets. While this seemed beneficial, it often meant animals were cooped up without options for socializing at dog parks or daycare centers. According to research from the SPCA, some pet owners struggled “to meet physical and psychological welfare needs” of their dogs, and many delayed veterinary visits and training.

All of these factors played a role in the rise of dog bite incidents during and after the 2020 lockdowns. If you or a loved one has been injured in such an incident, speaking with a qualified Encinitas dog bite lawyer is the best first step toward understanding your rights.

Understanding Dog Bite Trends Since the Pandemic

Have the trends reverted to pre-pandemic numbers, or are dog bite cases still occurring at a high rate? Recent data suggests the latter.

A recent study from DogsBite.org found that dog bite incidents have continued to rise in the post-COVID years. Furthermore, data from the Insurance Information Institute (Triple-I) and State Farm reveals that in 2023, the number of dog bite and related injury claims nationwide increased to 19,062—an 8.3% jump from the previous year.

California consistently ranks as the leading state for these incidents. In 2023, California led the nation in the number of dog bite insurance claims. Additionally, the U.S. Postal Service released rankings for dog attacks on mail carriers, placing San Diego—just south of Encinitas—as the city with the 6th highest number of attacks in the country.

It is possible that the continued rise in cases is linked to the sheer volume of new dog owners compared to pre-pandemic levels. Notably, there has not been a significant shift in the specific breeds involved in these bites. The data reinforces what animal researchers have emphasized for years: any dog can bite under certain circumstances, and breed alone is not the sole determining factor for risk.

California Law: Strict Liability for Dog Bites

If you are injured, it is crucial to seek legal advice about filing a claim for compensation. Many victims hesitate, believing they must prove the owner knew the dog was aggressive. However, California is a “strict liability” state under Civil Code § 3342.

This means you do not need to prove that the dog owner was negligent or that the dog had a “prior history” of biting (often called the “one-bite rule” in other states). Instead, you typically only need to show that the defendant owned the dog and that the bite occurred in a public place or while you were lawfully on private property. Because these laws can be specific regarding defenses like provocation, consulting an Encinitas dog bite lawyer is vital to protect your claim.

Preventing Dog Bite Injuries

Nearly all dog bites are preventable. According to the American Veterinary Medical Association (AVMA), it is critical to recognize body language that suggests an animal is anxious, scared, or sensing a threat. The AVMA also notes that children are the most common victims of dog bites and are far more likely to be severely injured. Teaching children to never approach an unfamiliar dog and to avoid disturbing a sleeping or eating animal is essential for safety.

Contact Our Encinitas Dog Bite Injury Attorneys Today

Avoiding a dog bite incident is obviously ideal, yet these attacks still occur and can cause serious, sometimes deadly harm. Children, in particular, tend to be at the greatest risk of debilitating injury.

When a dog bites, the owner is generally liable for the damages, including medical bills, lost wages, and pain and suffering. If you were injured in a dog attack, or if your child sustained a serious injury, do not navigate the insurance process alone. Our experienced Encinitas dog bite lawyer team can help you build your case and ensure you receive the compensation you deserve.

Whether you are decorating your home in Vista for the holidays, hosting friends and family for a holiday meal, or traveling outside California, the holidays are one of the most dangerous times of the year for personal injuries. While the holiday seasons can bring joy as friends and family members gather for food and time together after a difficult year or to celebrate achievements, there are many aspects of the holiday season that pose injury risks. Although nobody wants to think about the possibility of a serious or life-threatening accident or injury during the holidays, it is important to take precautions so that you can have the healthy and happy holiday break you are envisioning.

The following are some of the more common ways that people sustain personal injuries during the holiday season, along with ways to avoid them. And in the event a serious accident or injury does occur, you should know that a Vista personal injury lawyer at our firm is here to help.

Defective Products

Product defects can wreak havoc during the holiday season. Each year, lists of dangerous toys are released that can pose choking and suffocation hazards for young children, and risks of cuts and lacerations, as well as brain injuries and broken bones, among older children. In addition to defective toys, it is important to be aware of any other product defects that may cause injuries to you or your family members, including recalled motor vehicle parts, defective batteries, dangerous appliances, and more.

Hanging Decorations

Falls from hanging decorations are a common cause of serious injuries during the holiday season, according to the National Safety Council. Be sure you use the appropriate ladder for the job and that you only use a ladder as instructed.

Home Fires

Whether you are cooking on your stove or in your oven, deep frying a turkey, or placing candles or lights on or near a tree, it is critical to be aware of fire hazards during the holidays. Home fires are more common than you might think, and they are entirely avoidable.

Traffic Crashes

The holiday season is one of the most dangerous times of the year to be on the road. Although Southern California does not have the added risk of icy and snowy weather that other parts of the country experience, there are increased road accident risks due to drowsy driving, intoxicated driving, and simply because of more vehicles being on the road. According to the National Safety Council, you should avoid overnight driving, long stretches behind the wheel without a break, and any driving after consuming alcohol.

Contact Our Vista Personal Injury Lawyers for Help with Your Holiday Accident Claim

If you or someone you love sustained a serious injury during the holiday season, you still have time to seek advice from a personal injury lawyer in Vista about filing a claim for compensation. Generally speaking, you have two years from the date of an injury to file a personal injury lawsuit, but the sooner you get started, the easier it will be to gather relevant evidence to help you win your case. Contact North County Injury Lawyers today to find out more about how we can assist you with your personal injury claim in Vista or elsewhere in North County.

The recent incident at Pinsarella Ancient Roman Pizza in Vista, where an employee was severely injured after getting their leg caught in a pizza dough-cutting machine, is a stark and terrifying reminder of the dangers that can lurk in seemingly mundane workplace equipment. This extensive extrication, taking an hour to free the trapped worker, highlights the catastrophic consequences when machinery fails, or safety protocols are breached.

How Could This Happen in a Pizza Parlor?

While a pizza parlor might not immediately conjure images of heavy industrial risks, professional kitchen machinery, like large-scale dough mixers, rollers, and cutters, poses significant hazards. Entrapment injuries—where a body part gets caught, crushed, or pulled into a moving mechanism—typically occur due to a few common factors:

Missing or Bypassed Safety Guards:

Lack of Lockout/Tagout Procedures: Lockout/Tagout (LOTO) is a critical safety protocol. When a machine is being serviced, cleaned, or unjammed, it must be completely disconnected from its energy source (locked out) and tagged. Failure to follow LOTO means the machine could be inadvertently started while an employee is reaching into the mechanism.

Fatigue or Distraction: Repetitive tasks and long hours can lead to a momentary lapse in concentration, causing an employee to slip, misjudge a movement, or reach into an area they shouldn’t while the machine is running.

Equipment Malfunction: Less common, but still a risk, is a mechanical or electrical failure that causes a part to move unexpectedly or a safety shutoff to fail.

In the case of a dough cutter, an employee may have been attempting to clear a jam, clean excess dough, or adjust a setting while the cutting blade or roller was still powered, leading to the severe injury.

Understanding California Product Liability Law

When a workplace injury like this occurs, the employee’s primary recourse is through Workers’ Compensation. However, the incident also raises serious questions about the equipment itself and the manufacturer’s responsibility under California Product Liability Law.

A manufacturer can be held liable if a piece of equipment is found to be “defective” and that defect caused the injury. California law recognizes three main types of product defects:

Manufacturing Defect: The product differs from the manufacturer’s intended design (e.g., a critical weld breaks).

Design Defect: The product’s design itself creates an unreasonable danger to the consumer or user, and there was a safer, economical, and technically feasible alternative design available. In the context of industrial equipment, this often involves the placement or effectiveness of safety guards and shutoff mechanisms. If the pizza dough cutter’s design made it too easy to bypass safety guards, it could be deemed defective.

Failure to Warn (Marketing Defect): The manufacturer failed to provide adequate warnings or instructions about non-obvious dangers associated with the product’s use.

For the pizza parlor incident, the critical question under product liability would be: Did the dough-cutting machine create an unreasonable danger to the employee? If the design of the guard system was insufficient to prevent access to the moving blades during normal operation or foreseeable misuse, the manufacturer could be held accountable, distinct from the employer’s liability. This is crucial because a successful product liability claim can provide the injured worker with compensation for pain, suffering, and lost wages beyond what Workers’ Compensation offers.

The tragic event serves as a critical call for all businesses to rigorously enforce safety protocols, and for manufacturers to prioritize worker safety above all else when designing and building the tools of the trade.

We hope the employee makes a fully recovery.

Over the last several years, e-bikes have experienced a significant rise in popularity throughout Southern California cities and towns, including Carlsbad, Oceanside, and Encinitas. Yet e-bikes have also been linked to a rise in personal injury rates, including serious harm that includes bone fractures and traumatic brain injuries (TBIs). To be sure, the American College of Surgeons recently reported that e-bikes are linked to at least 20,000 injuries and 3,000 hospitalizations annually, and those numbers are likely underreported. Despite known risks, e-bikes continue to gain popularity.

Recognizing that these motorized vehicles may be here to stay, the California Independent Electric Mobility Council was formed in October 2025, and it will begin studying the safety risks associated with e-bike usage in the state.

Council Plans to Study E-Bike Safety and Injury Risks

The newly formed California Independent Electric Mobility Council, according to a report from California Public Radio, was created through a grant from Honda. The Council’s task will be to “study what makes e-bikes dangerous” while also assessing “how to make them safer without discouraging people from using them.” If e-bike popularity is going to remain, it is crucial for e-bike makers and riders alike to know how injuries can be avoided.

The Council is made up of a range of people, including trauma nurses, CalBike policy directors, and engineers, among others.

Filing an E-Bike Injury Claim in Southern California

If you were injured in an e-bike accident, or if someone you love was injured in an e-bike accident, you may be wondering about your options for filing a claim. The safety risks associated with these vehicles are well known, but that does not mean that another party may not be liable for injuries. To be sure, there are various circumstances in which another motorist, or even a bicyclist or another e-bike rider, could be responsible for a collision in which an e-bike rider has been harmed.

You should also keep in mind that California follows a “pure” comparative fault rule, which means that even if you were partially at fault for an e-bike accident in which you were injured, you can still recover damages from another party or parties whose negligence also played a causal role in the accident.

In order to file a claim, it is critical to get in touch with a personal injury lawyer in Carlsbad who can help you determine who may be liable for your injuries and gather evidence proving that party should be held responsible. Under California law, you will likely have only two years from the date of the e-bike accident to file your lawsuit, so it is essential to begin working on your case with an attorney as soon as possible.

Contact a Carlsbad Personal Injury Attorney for Assistance with Your Claim

E-bikes are dangerous, but injured riders may be able to seek compensation for injuries after a serious accident. It is important for you to know that you are not liable for your own injuries simply because you decided to ride a motorized bike that comes with risks. If another party’s negligent or careless behavior caused an accident in which you were injured, one of our Carlsbad personal injury attorneys can help you to seek financial compensation for your losses. Contact the North County Injury Lawyers today to find out more about filing an e-bike injury claim in California.

A serious multistate listeria outbreak, first reported in June, has taken another tragic turn. The Centers for Disease Control and Prevention (CDC) has confirmed new cases and deaths linked to prepared pasta meals sold at major grocery stores across the country. If you or a loved one have become ill, it is critical you understand the details of this outbreak and your rights.

What You Need to Know About the Outbreak

This dangerous outbreak now spans 18 states, including California, Oregon, Texas, and Hawaii, resulting in 27 confirmed cases and, tragically, six deaths. The U.S. Food and Drug Administration (FDA) confirmed that pasta within these ready-to-eat meals tested positive for Listeria monocytogenes.

These contaminated meals were sold at numerous popular grocery stores, including:

Walmart

Albertsons

Trader Joe’s

Kroger

Giant Eagle

Sprouts

The Dangers of Listeria Infection

A listeria infection is a serious matter. The bacteria can cause severe illness, especially for pregnant women (it has been linked to fetal loss), newborns, adults over 65, and individuals with weakened immune systems.

While some people may only experience mild, short-term illness with fever and diarrhea, the infection can become invasive. When it spreads beyond the gut, it can attack the brain and spinal cord, leading to life-altering symptoms like high fever, severe headaches, stiff neck, and confusion. According to the CDC, six of the seven newest cases required hospitalization.

The CDC is advising all consumers to check their homes for these recalled products. Do not eat them. Either throw them away or return them to the store for a refund.

Have You Been Affected? You Have Legal Options.

If you or a family member consumed a recalled pasta meal and subsequently suffered from a listeria infection, you are not just a statistic. Food manufacturers and retailers have a legal and moral responsibility to ensure the products they sell are safe for consumption.

When they fail in that duty, the victims suffer. The medical bills for a serious infection can be overwhelming, not to mention the lost wages from time off work and the immense pain and suffering.

You do not have to bear this burden alone. The experienced foodborne illness attorneys at North County Injury Lawyers specialize in holding negligent companies accountable. We understand the complexities of listeria cases and are ready to fight to get you the justice and compensation you deserve.

If you have been impacted by this devastating listeria outbreak, contact our team immediately for a free, confidential consultation to discuss your case and understand your legal rights.

Oceanside motorists, pedestrians, bicyclists, and motorists are once again experiencing the effects of clocks going back. The annual time change that occurs on the first Sunday in November each year results in more daylight in the early morning and less daylight at the end of the day. On some of the darkest winter days of the year, even in Southern California, evening drives home from work can have very little light, and pedestrians and cyclists on the roads after the end of the workday can find themselves in complete darkness. The time change leads to more traffic collisions and injuries. Our Oceanside personal injury lawyers can tell you more.

Causes of Time Change Car Crashes

When the clocks “fall back” in the autumn or “spring ahead” in the spring, more car accidents happen in the weeks that follow. Each year, the time change impacts motorists’ ability to drive safely.

Indeed, according to a report from the National Institutes of Health (NIH), even moving clocks back or forward by an hour can result in “sleep deprivation and circadian rhythm disruptions,” which “are known to decrease attention and alertness.” As a result, drivers cause and are involved in more collisions.

Autumn Clocks Going Back Coincides With Increase in Accident Rates

Data routinely shows that time changes in both parts of the year — spring and fall — are associated with more collisions because of how the time change impacts a driver’s sleep habits and adjustments to driving on a different sleep schedule. Yet the time change that happens in early November tends to be linked to a higher rate of collisions than the time change in the spring. According to a study published in the Journal of Safety Research, the springtime change shows a decrease in nearly all types of collisions, but most importantly, those that occur in the evening hours.

During the fall, according to the data reported in the Journal of Safety Research, the autumn time change results in a 15% increase in freeway accidents, a 9% increase in intersection collisions, a 12% increase in urban traffic crashes, and an increase in dusk and nighttime crashes by nearly 30%. The more limited light with the clocks turning back, especially when so many drivers are on the road at the end of most weekdays while commuting home from work or running post-work errands, makes those evening hours some of the most dangerous times to be a pedestrian, cyclist, or motorist.

Contact an Oceanside Auto Accident Lawyer Today for Assistance

If you or someone in your family was recently injured in a collision with a negligent motorist, it is important to find out more about seeking financial compensation. With less daylight in the fall and winter, more accidents are likely to happen in the post-workday hours, especially around dusk. Drivers need to exercise increased caution, but it is also important to hold a driver accountable for any harm they cause due to their own careless behavior. One of our Oceanside auto injury attorneys can speak with you about your options for seeking compensation.
How much time does a pedestrian in Oceanside have to cross a street at a crosswalk with a “walk” indicator before the light for turning vehicles turns green? According to a recent study conducted by researchers at Columbia University, extra seconds could make a significant difference in reducing the rate of pedestrian injuries in vehicle collisions. In many urban and suburban areas with crosswalks and traffic lights, the “walk” signal for pedestrians lights up just as vehicle traffic at the cross intersection gets a green light. What this means is that pedestrians are beginning to step into the crosswalk just as vehicles turning at the intersection are getting a green traffic signal that allows them to make a turn through that same crosswalk. A surprisingly high number of collisions occur in that moment, the new research suggests.

What should drivers and pedestrians know about the new study? Our Oceanside personal injury lawyers can tell you more.

Research Addresses Visibility of Pedestrians at Intersections

The new research, which was published in the journal Nature Cities, assessed data from more than 6,000 urban intersections over a five-year period. What it found is that, when pedestrians have more lead time to begin walking across a street before the light turns green and allows vehicles to turn, pedestrians are less likely to be involved in collisions with turning vehicles. The research suggests that pedestrians are simply more visible to turning cars and trucks when they have time to reach the middle of the crosswalk before vehicles have the ability to turn on green.

Adding Seconds Can Prevent Pedestrian Injuries

A type of intervention known as a “Leading Pedestrian Intervention,” or LPI, can save pedestrian lives and prevent injuries in collisions, the researchers suggest. LPIs are simply interventions that give pedestrians more lead time before a green traffic signal that allows vehicles to turn. The typical LPI time is anywhere from 7 to 11 seconds — in other words, a head start of 7 to 11 seconds. And those seconds can make a significant difference.

The research suggests that even a 7-second lead time for pedestrians can reduce injuries by approximately 33% and fatal pedestrian collisions by approximately 65%. The results are particularly “dramatic during daytime hours,” according to a Consumer Affairs report on the study. As the lead author of the study, Christopher Morrison, explained, “most pedestrian-vehicle crashes happen near the curb, where drivers are less likely to see people crossing.”

If you were injured in a pedestrian collision with a motor vehicle, or if you lost someone you love in a collision, it is important to seek legal advice as soon as you can. The statute of limitations for these types of accidents only gives you a limited amount of time to file a claim and to hold the driver accountable.
