Pedestrian Deaths in North County: What Families Should Know

North County Injury Lawyers

Every day, people in Escondido, San Marcos, Vista, Oceanside, Carlsbad and the rest of North County San Diego walk to work, school, shops and bus stops. Too many are hit by drivers who were speeding, distracted or impaired. According to Dangerous by Design, a national report by the non-profit Smart Growth America, California is among the more dangerous states for people on foot, and several California metro areas, including parts of the Inland Empire, have ranked among the most dangerous in the country. [VERIFY report year, ranking, and figures before publishing.]

If someone you love was killed or seriously hurt while walking, you do not have to face the insurance companies alone. North County Injury Lawyers represents families throughout North County San Diego.

Why Streets Can Be So Dangerous for Pedestrians

The report finds that the most dangerous areas tend to have streets built for cars, not people. In its words, “when roads are wide and straight, lanes are wide and plentiful, and intersections are infrequent or nonsignalized, people feel comfortable driving faster.” That is true even where speed limits are low, because drivers go faster on roads that feel open.

You can see this pattern across North County:

  • Escondido: Busy arterials such as Centre City Parkway and Valley Parkway, with long distances between crossings.
  • San Marcos and Vista: Wide boulevards and shopping-center driveways where drivers focus on turning and parking, not people on foot.
  • Oceanside and Carlsbad: Heavy traffic near beaches, transit and busy coastal corridors, often in low light.

When the road design offers few safe crossings, a driver’s carelessness can turn deadly. El Camino Real, for example, has numerous dangerous intersections from Oceanside through Encinitas.

Who Is Responsible When a Pedestrian Is Killed?

In many pedestrian fatalities, the driver was negligent. Common causes include:

  • Speeding
  • Texting or other distracted driving
  • Driving under the influence of alcohol or drugs
  • Failing to yield to a pedestrian in a crosswalk (California drivers must yield to pedestrians in a crosswalk; see Vehicle Code § 21950)
  • Unsafe turns at intersections and driveways

Others may share responsibility. A city or agency may be liable for a dangerous roadway, a missing signal or crosswalk, or poor lighting, and an employer may be liable when its driver was on the job. Claims against a government entity have very short filing deadlines, sometimes only six months, so it matters to act quickly.

Who Can File a Wrongful Death Claim?

Under California law (Code of Civil Procedure § 377.60), a wrongful death claim can generally be brought by the decedent’s surviving spouse or domestic partner and children. If there are none, other heirs, such as parents or siblings, may be able to bring the claim. In some cases, a financially dependent family member may also qualify. Which family members can sue, and how a recovery is divided among them, depends on the facts. We will go over this with you at the start.

A wrongful death case may allow a family to seek compensation for funeral and burial costs, medical bills, lost financial support, and the loss of the loved one’s companionship, comfort and guidance. In California, the deadline to file is generally two years from the date of death, so please do not wait.
